网购消费者后悔权行使中的困境与对策

【摘要】：科学技术的发展与进步,大大改变了人们的生活方式,网络购物以其自身独有的特点越来越流行。但是网购很大程度上是基于经营者的宣传而非对产品的质量、性能、用途等的真实了解和切身体验,因此网购消费者权益受到侵害的问题越来越突出。为此,2013年10月25日,第十二届全国人民代表大会常务委员会第五次会议审议通过了《全国人民代表大会常务委员会关于修改中华人民共和国消费者权益保护法的决定》,增加了消费者后悔权的规定。这样一项新的权利的出现,在保护网购消费者权益方面无疑会起到巨大的作用。但是我们也应该认识到我国的后悔权规定还是很初步的、很不完善的,很多规定还比较笼统模糊,如商品应当完好的规定。与此同时,我国的后悔权内容也没有对后悔权滥用问题进行规定,可能导致权利滥用,影响正常的经济秩序。因此,后悔权的行使面临着巨大的困境与挑战。基于此,为了更加规范网购消费者后悔权的行使,更有利的保障网购消费者的合法权益,维护正常的经济秩序。本文结合案例、自身经验以及国内外实践对我国后悔权规定在实践中面临的一系列困境加以分析并提出相应的对策,以期对我国后悔权规定的进一步完善提供一定的借鉴。
[Abstract]:With the development and progress of science and technology, people's way of life has been greatly changed. However, online shopping is largely based on the operator's propaganda rather than the real understanding and personal experience of product quality, performance, use, etc. Therefore, the problem of infringement of consumers' rights and interests is becoming more and more prominent. To this end, on 25 October 2013, At its fifth session, the standing Committee of the Twelfth National people's Congress deliberated and adopted the decision of the standing Committee of the National people's Congress on amending the Law on Protection of Consumer Rights and interests of the people's Republic of China, adding provisions on the right of consumers to regret. The emergence of such a new right, in the protection of online shopping consumer rights and interests will undoubtedly play a huge role. However, we should also realize that the provisions on the right of regret in our country are still very preliminary, very imperfect, and many of the provisions are still relatively vague, such as the provisions that the commodities should be intact. At the same time, the content of the right of regret in our country does not provide for the abuse of the right of regret, which may lead to abuse of the right and affect the normal economic order. Therefore, the exercise of the right of regret is faced with great difficulties and challenges. Based on this, in order to regulate the exercise of consumers' right of regret, to protect the legitimate rights and interests of consumers, to maintain normal economic order. This paper analyzes a series of predicaments that our country regret right stipulation faces in practice with case, own experience and domestic and foreign practice, and puts forward the corresponding countermeasure, in order to provide certain reference to our country regret right stipulation further consummation.
