陈莺诉罗荣耕监护权纠纷案件评析

【摘要】：现代社会科学技术蓬勃发展,人们的生殖方式也随之发生变化,不仅有传统的有性生殖,先进的人工生殖辅助技术悄然而生。代孕技术的诞生及其广泛运用,使得不能生育的妇女圆了生子梦,为众多不能生育的家庭带来喜讯。代孕不论对缓解人口老龄化还是维持社会持续发展与和谐稳定都发挥特别重要的作用。可是代孕技术具有两面性,它在帮助人类繁衍的同时,也对现有的法律制度和伦理道德造成强大的冲击,特别是突破了传统的法律思维定式,向传统意义上的亲子身份确认方式发出巨大挑战。1然而当前我国关于代孕监护权认定方面存在立法空白,仅在两部行政规章中宣誓性地规定不允许医疗机构从事代孕事宜,再加之现有的亲子关系认定法则对代孕子女不能全部适用,不能解决他们的身份认定问题,因此对代孕情况下监护权认定问题进行规范和控制成为当务之急。本文以陈莺诉罗荣耕监护权纠纷案-全国第一例因代孕而发生的监护权纠纷案件为切入点,对相关理论和学说进行梳理并提出具体对策,以期为我国立法和司法实践提供完善建议。本文共分四大部分。第一章是绪论,论说本文的背景、目的等情况信息。第二部分,陈莺诉罗荣耕监护权纠纷案简述。对判决结果和作出判决结果的依据进行介绍。第三部分,陈莺诉罗荣耕监护权纠纷案焦点分析,包括代孕引发的亲子关系如何认定及监护权如何归属等问题,并细化展开。第四部分,围绕案件的争议焦点,对代孕后亲子关系如何认定和监护权如何确定提出建议和对策。
[Abstract]:With the rapid development of science and technology in modern society, people's reproductive mode has changed, not only the traditional sexual reproduction, but also the advanced assisted technology of artificial reproduction quietly. The birth of surrogate technology and its wide application make infertile women have a dream of having children and bring good news to many infertile families. Surrogacy plays a particularly important role in alleviating population aging and maintaining social sustainable development and stability. However, surrogate technology has two sides. It not only helps human beings to reproduce, but also has a strong impact on the existing legal system and ethics. In particular, it breaks through the traditional legal thinking formula. A great challenge to the traditional parent-child identification. However, there is currently a legislative gap in our country regarding the determination of custody of surrogate pregnancy. Only in two administrative rules and regulations do we swear that medical institutions are not allowed to engage in surrogate pregnancy. In addition, the existing rules of parent-child relationship can not be fully applied to surrogate children, can not solve their identity identification problem, so it is urgent to regulate and control custody identification in surrogate pregnancy. Based on Chen Ying v. Luo Ronggeng custody dispute case, the first custody dispute case caused by surrogate pregnancy in China, this paper combs the relevant theories and puts forward specific countermeasures. In order to provide perfect suggestions for our legislative and judicial practice. This paper is divided into four parts. The first chapter is the introduction, the background of this paper, the purpose of the situation information. The second part, Chen Ying v. Luo Ronggeng custody dispute briefly. The result of judgment and the basis of making decision are introduced. The third part, Chen Ying v. Luo Ronggeng custody dispute focus analysis, including surrogacy caused by parent-child relationship how to determine and custody of how to assign, and detailed development. The fourth part, around the dispute focus of the case, how to determine the paternity and custody after surrogate pregnancy and how to put forward suggestions and countermeasures.
