借名购房协议的效力分析

【摘要】:借名购房是随着我国房地产市场发展,各种房地产政策出台产生的一种新兴的现象。借名购房的出现导致相关的法律问题应运而生。借名购房过程中,当事人通常会达成借名购房协议,这份协议一般以书面或者口头的形式存在。目前,借名购房协议在理论和实践中的研究还存在很大的困境。在理论中,学者们对借名购房协议的性质及效力看法不一,学术上对借名购房协议也还没有统一规范的表达。在司法实践中,借名购房协议作为认定当事人之间是否存在借名购房关系和确定房屋所有权归属的重要依据,法院对借名购房协议效力的认定标准也大相径庭。因此,本文通过了解借名购房协议的含义来认识什么是借名行为,借名购房行为,借名购房协议在法学语境下的定义。通过探讨借名购房协议的法律性质来认识其受到哪种法律法规的约束和保护。通过分析借名购房协议的效力来明确在相关法律的规制下其有效和无效的情形。在借名购房协议有效的前提下,通过讨论房屋所有权归属问题来明晰房屋的事实所有权和法律所有权。最后,针对借名购房现在的发展状况及存在的问题,为借名购房制度的完善提出了一些相关建议。本文通过重点分析借名购房协议的效力,让借名购房的法律问题更加清晰,使借名购房制度在理论和实践中更加完善。
[Abstract]:With the development of China's real estate market, various real estate policies come into being as a new phenomenon. The appearance of the borrowed house leads to the emergence of related legal problems. In the process of loan purchase, the parties usually reach a loan purchase agreement, which usually exists in written or oral form. At present, there are still a lot of difficulties in the theory and practice of the loan-name purchase agreement. In theory, scholars have different views on the nature and effectiveness of the loan-to-name purchase agreement, and there is no unified and normative expression of the loan-to-name purchase agreement. In judicial practice, as an important basis to identify the relationship between the parties and determine the ownership of the house, the court also has different standards for the validity of the loan purchase agreement. Therefore, this paper, by understanding the meaning of the loan-name purchase agreement to understand what is the act of borrowing, the definition of the loan-name purchase agreement in the legal context. This paper discusses the legal nature of the loan purchase agreement to understand which laws and regulations it is bound by and protected. By analyzing the validity of the loan purchase agreement, it is clear that it is effective and invalid under the regulation of relevant laws. On the premise of the validity of the loan-name purchase agreement, the ownership of the house is discussed to clarify the real ownership and legal ownership of the house. Finally, in view of the current situation and existing problems, some suggestions are put forward for the perfection of the system. Through the analysis of the effectiveness of the agreement, this paper makes the legal problems of the loan purchase more clear, and makes the system of borrowing purchase more perfect in theory and practice.
