建设工程施工合同索赔时效若干问题研究

【摘要】：正 建设工程施工合同索赔时效,是指在施工合同履行过程中,索赔方在索赔事件发生后的约定期限内个行使索赔权的,视为放弃索赔权利,其索赔权归于消灭的合同法律制度。约定的期限即索赔时效期间,一般为28天。该种索赔时效,属于消灭时效的一种。 索赔时效的规定,见诸于各类合同范本中。如建设部、国家工商总局制定的《建设工程施工合同》(GF-1999-0201)通用条款36.2条规定:“索赔须在索赔事件发生后28
[Abstract]:The term of limitation of claim for a construction contract under construction is defined as a waiver of the right to claim if the claimant exercises the right of claim within the agreed time limit after the occurrence of the claim in the course of the execution of the construction contract, Its right of claim is attributed to the legal system of contract of extinction.
