技术标准中必要专利问题研究

【摘要】：随着技术创新速度加快,全球经济一体化程度加深,标准和专利作为技术推广的重要手段,不可避免地结合在一起。然而带有公益性的技术标准与私权性的专利权结合后,产生了“1+12”的市场效应,稍有不慎可能会形成新的技术垄断,由此引发技术标准中必要专利相关问题的研究。本文主要是对技术标准中必要专利问题进行研究和探索。第一部分是技术标准中必要专利的概述。主要介绍技术标准的概念,分析技术标准和专利技术结合的必然性,在此基础上,结合国内外关于必要专利的定义,明确必要专利的概念,分析必要专利的特征,区分必要专利权利要求和必要专利。第二部分是技术标准中必要专利的认定问题。通过分析必要专利认定的重要性,阐述技术标准中必要专利的认定标准和认定主体。主要从技术因素、法律因素和商业因素具体论述必要专利的认定标准,并且结合认定中存在的问题确定技术标准中必要专利的认定主体。第三部分研究技术标准中必要专利存在的问题。从必要专利的特点出发,结合相关案例分析技术标准中必要专利存在的问题及其原因,从而引出下文关于技术标准中必要专利的规制的讨论。第四部分阐述技术标准中必要专利的主动规制。结合技术标准中必要专利存在的问题,从标准化组织的专利政策出发,论述专利信息披露和FRAND许可原则。重点解读FRAND许可原则,并对FRAND许可的法律性质进行分析。第五部分论述技术标准中必要专利的被动规制。通过分析完全限制禁令救济、完全不限制禁令救济和有条件限制禁令救济在标准必要专利纠纷案件中的运用,从而探寻最适合解决必要专利纠纷的禁令救济。重点阐述对标准必要专利的反垄断规制,结合国内外反垄断的经验和技术标准中必要专利的垄断行为特征,从技术标准这一公共平台的角度进行综合的法律价值判断,制定适合标准必要专利的反垄断措施。
[Abstract]:With the acceleration of technological innovation and the deepening of global economic integration, standards and patents, as an important means of technology promotion, are inevitably combined together. However, the combination of the technical standard with public welfare and the patent right of private right has produced the market effect of "112", which may form a new technology monopoly, which leads to the research of the necessary patent related problems in the technical standard. This paper is mainly about the research and exploration of the necessary patent in the technical standard. The first part is an overview of necessary patents in technical standards. This paper mainly introduces the concept of technical standard, analyzes the inevitability of the combination of technical standard and patent technology, and on this basis, with the definition of necessary patent at home and abroad, clarifies the concept of necessary patent, and analyzes the characteristics of necessary patent. Distinguish between essential patent claims and essential patents. The second part is the identification of necessary patents in technical standards. By analyzing the importance of necessary patent recognition, this paper expounds the identification standard and subject of necessary patent in technical standard. This paper mainly discusses the identification standards of necessary patents from technical factors, legal factors and commercial factors, and determines the main body of the necessary patents in technical standards in combination with the problems existing in the identification. The third part studies the problems of the necessary patent in the technical standard. Starting from the characteristics of necessary patents, this paper analyzes the problems and causes of necessary patents in technical standards by combining relevant cases, and then leads to the discussion on the regulation of necessary patents in technical standards below. The fourth part expounds the active regulation of the necessary patent in the technical standard. Combined with the problems of necessary patents in technical standards, this paper discusses the principles of patent information disclosure and FRAND licensing from the perspective of the patent policy of the Organization for Standardization. Focus on the interpretation of FRAND licensing principles, and the legal nature of FRAND licensing analysis. The fifth part discusses the passive regulation of necessary patents in technical standards. Based on the analysis of the application of complete restriction prohibition relief, no restriction ban relief and conditional prohibition relief in standard essential patent disputes, the author tries to find out the most suitable prohibition relief for resolving necessary patent disputes. This paper focuses on the anti-monopoly regulation of standard essential patents, combined with the anti-monopoly experience at home and abroad and the monopoly behavior characteristics of necessary patents in technical standards, and makes a comprehensive legal value judgment from the point of view of technical standards as a public platform. To formulate antitrust measures suitable for the necessary patents of the standard.
