网络转发侵权若干问题研究

【摘要】：自2009年《侵权责任法》增加了第三十六条网络侵权的内容之后,相关研究在法学界如雨后春笋般蓬勃发展,但在成果丰硕的背后,又难以避免的隐藏了一些问题,这其中就包括网络转发行为侵权的法律研究及相关成果相对匮乏。随着转发行为的日益增多,转发侵权日益频发,相关的侵权问题研究空白使得法律对转发侵权行为的约束力显得十分苍白,恶意转发行为泛滥,网络环境难以净化。网络转发侵权行为受转发行为主体不同、转发方式不同等因素的影响,其侵权的内容和表现形式较为复杂多样,不同的情况需要从不同的角度出发进行考察,本文就针对网络转发侵权的不同情形,给出了具体的法律分析。由于相关领域研究成果较少,本文具有较强的创新性。本文首先明确了网络转发行为与转发者的概念及其内在的联系,讨论了转发者需对转发行为导致的后果承担责任的理论基础。之后从网络侵权出发,引出网络转发侵权这一本文核心问题,探讨了其特点及表现形式,以我国现行的侵权责任归责原则体系为基础,对网络转发侵权问题适用的归责原则进行了界定。最后,侵权问题的落脚点是侵权责任的认定与承担问题,本文以一般侵权责任的构成要件为基础,提出了网络转发侵权责任认定需遵循的原则。针对侵权责任的分配问题,因不同侵权主体的身份随具体情景而变化,本文对不同情形下各侵权主体之间的责任分配进行了讨论,并尝试给出较为全面的结论。
[Abstract]:Since the "Tort liability Law" in 2009 added the content of article 36 network infringement, the related research has been booming in the legal circles, but behind the fruitful results, it is difficult to hide some problems. This includes the relative lack of legal research and related achievements of network forwarding tort. With the increasing number of forwarding acts and the frequent occurrence of forwarding infringement, the research blank of related tort issues makes the binding force of the law on forwarding tort appear very pale, malicious forwarding is rampant, and the network environment is difficult to purify. Network forwarding tort is affected by different subjects and different ways of forwarding. The contents and forms of infringement are complex and diverse. Different situations need to be investigated from different angles. This paper gives a specific legal analysis on the different cases of network forwarding infringement. Due to the lack of research results in related fields, this paper has a strong innovation. This paper firstly clarifies the concept of network forwarding behavior and its internal relationship, and discusses the theoretical basis on which the network forwarding behavior should be held responsible for the consequences caused by the forwarding behavior. Then, starting from the network tort, this paper leads to the core problem of network forwarding infringement, discusses its characteristics and forms of expression, based on the current tort liability imputation principle system of our country. This paper defines the principle of imputation applied to the problem of network forwarding infringement. Finally, the focus of tort is the identification and bearing of tort liability. Based on the constitutive elements of general tort liability, this paper puts forward the principles to be followed in the identification of network forwarding tort liability. In view of the distribution of tort liability, because the identity of different torts varies with the specific situation, this paper discusses the distribution of liability among the torts under different circumstances, and tries to give a more comprehensive conclusion.
