新闻侵权责任构成的理论分析

【摘要】：新闻侵权现已成为新闻界和法学界关注的热点问题,新闻侵权责任研究重点要解决的问题是明晰新闻自由权利行使和新闻侵权责任之间的界限。新闻侵权责任的构成要件,系形成这种平衡最为重要的法律工具。本文新闻侵权责任的分析框架从结构上分为两部分进行,第一部分为文章的基础理论部分,该部分围绕新闻自由与私权利保护的冲突与平衡内容展开论述；该部分也是问题的引入,由于在以往的新闻侵权责任的研究中,从事新闻研究的学者和从事法学研究的学者往往分头进行,并没有对这个问题进行一个很好的结合。故此部分引出了将新闻侵权中存在的价值问题与法学理论相结合的研究路径。第二部分为第二、三章内容,也主要沿着第一部分的思路结构,围绕新闻侵权责任构成征引“三阶层”理论展开详细论述。虽然各个具体构成的内容与一般侵权责任构成论述无特异之处,但本文在分析框架上有别于一般侵权责任框架的探讨。本文欲构筑的新闻侵权责任构成要件模式亦是为被严格限定的新闻侵权责任构成模式下的三阶层理论；故而在论述顺序上严格遵从了“构成要件符合性—违法性—有责性”的阶层论述顺序。在本文中笔者试图通过学科融合的态度,采各学科理论各自的优势结合研究,期望能够对建立新闻侵权责任完整的体系的建构有所帮助,并在实践中切实的对新闻自由与人格权保护的处理提供一定的借鉴意义。
[Abstract]:News tort has become a hot issue that the press and law circles pay close attention to. The focus of the research on news tort liability is to clarify the boundary between the exercise of freedom of the press and the tort liability of news. The constitution of news tort liability is the most important legal tool to form this balance. The analysis frame of the news tort liability is divided into two parts. The first part is the basic theory part of the article, which focuses on the conflict and balance between the freedom of the press and the protection of private rights. This part is also the introduction of the problem, because in the past research of news tort liability, the scholars engaged in journalism research and the scholars engaged in legal research often separate, and did not do a good combination of this problem. Therefore, this part leads to the research path of combining the value problem in news tort with the theory of law. The second part is the content of the second and third chapters, but also mainly along the train of thought structure of the first part, focusing on the theory of "three strata" of the constitution of news tort liability. Although the contents of each specific constitution and the general tort liability constitution are not unique, this paper is different from the general tort liability framework in the analysis framework. The model of the constitutive elements of news tort liability, which this paper intends to construct, is also a three-class theory under the strictly defined model of news tort liability. Therefore, the order of argumentation strictly obeys the hierarchy order of conformance-illegality-responsibility. In this paper, the author tries to combine the advantages of each discipline theory through the attitude of subject fusion, hoping to be helpful to the establishment of a complete system of news tort liability. And in practice to the freedom of the press and the protection of personality rights to provide certain reference.
