论产品自身损害——兼论产品责任中的纯粹经济损失

【摘要】：产品自身损害以及因产品缺陷引起的其他类型的损失之中何种损失能够解释为《侵权责任法》第41条所规定的"损害",必须通过类型化而后进行利益平衡、价值判断决定。产品因缺陷毁损灭失是对所有权的侵害,产品用户可以根据《侵权责任法》第41条请求损害赔偿。产品因存在缺陷价值降低和修理费用亦应解释为该条所规定的"损害",此时该条创设了一种法定之债。对于丧失的营业利润和责任损害,不应认其属于该条所规定的"损害"。
[Abstract]:The damage of the product itself and other types of loss caused by the defect of the product can be interpreted as the "damage" stipulated in Article 41 of the Tort liability Law. The damage and loss of the product due to defects is an infringement of ownership, and the user of the product may claim damages according to Article 41 of the Tort liability Law. The reduction in the value of the product due to defects and the cost of repairs shall also be interpreted as "damage" as stipulated in the Article, which creates a statutory debt. Loss of operating profits and liability damage shall not be considered as "damage" under that article.
