“三改一拆”视域下农村违法建筑的价值冲突及法治建构

【摘要】：违法建筑问题是居者有其屋的民生保障和承载着公益的规划理性之间的冲突,随着城市化的推进,越来越多的农村受城市辐射影响,城乡之间的经济文化社会在多方面多领域之间发生碰撞,这需要法治的建构来将冲突限制在一定限度。而城郊村和城中村作为最典型的矛盾结合体,由于原生秩序的破坏而新秩序未立等诸方面原因使得其违法建筑问题尖锐,面对这些问题,本文认为一要促进农村和城镇在管理模式上的协调,二要构建社会矛盾调节机制,三要加快立法和执法的统一。
[Abstract]:The problem of illegal building is a conflict between the livelihood security of home ownership and the planning rationality that carries public welfare. With the development of urbanization, more and more rural areas are affected by urban radiation. The economic and cultural society between urban and rural areas collides in many fields, which requires the construction of the rule of law to limit the conflict to a certain limit. As the most typical combination of contradictions, the suburban village and the village in the city, due to the destruction of the primary order and the absence of a new order, make the illegal construction problems acute. In the face of these problems, This paper holds that one is to promote the coordination between rural and urban management mode, the other is to construct a social contradiction adjustment mechanism, and third, to speed up the unification of legislation and law enforcement.
