论我国商标注册诚信原则运用机制的改进

【摘要】：我国商标主管机关和法院有丰富的商标注册具体条款运用经验,可是它们在适用商标注册诚信原则一般条款方面的经验匮乏。它们对诚信原则所做的泛道德性解读,不仅难以明晰该原则的潜在规制边界,而且无益于对商标注册具体条款空白或缺陷的弥补。鉴于此,对商标注册诚信原则的运用机制提出一些改进建议:以诚信/恶信二分法对我国商标法中的商标注册具体条款进行了类型化区分,以便对具体条款的适用提供更加体系化的科学指导;直接适用诚信原则禁止有妨碍竞争意图的商标抢注或投机注册行为,赋予在先使用人提出异议或请求宣告无效、提起侵权抗辩或反诉的权利,进而维护公平竞争秩序和市场竞争者的民事权益或利益。
[Abstract]:China's trademark authorities and courts have rich experience in the application of specific terms of trademark registration, but they lack experience in applying the general terms of the principle of good faith in trademark registration. Their general moral interpretation of the principle of good faith is not only difficult to clarify the potential regulatory boundaries of the principle, but also does not help to remedy the gaps or defects in the specific provisions of trademark registration. In view of this, some suggestions are put forward to improve the application mechanism of the principle of good faith in trademark registration: the dichotomy of good faith and bad faith is used to classify and distinguish the specific terms of trademark registration in China. In order to provide more systematic scientific guidance for the application of specific articles; The direct application of the principle of good faith prohibits any act of preemption or speculative registration of a trademark which hinders the intention of competition, endows the first user with the right to raise an objection or a request for invalidation, and to lodge a tort defense or counterclaim, Then maintain fair competition order and the civil rights and interests of market competitors.
