新闻出版业版权保护的困境与对策——基于集体行动理论的视角

【摘要】：版权保护对新闻出版业的健康发展至关重要,但新闻出版业并未建立起有效的版权保护机制。文章运用公共选择理论中的集体行动理论,从新闻出版业作为大集团和排外集团的性质入手,分析新闻出版业版权保护陷入困境的原因,并提出走出困境的对策:对新闻出版机构进行选择性激励,调整新闻出版业市场结构,建立鼓励合作的元规范。
[Abstract]:Copyright protection is of great importance to the healthy development of the press and publishing industry, but it has not established an effective copyright protection mechanism. Based on the theory of collective action in the theory of public choice, this paper analyzes the reasons for the predicament of copyright protection in the press and publication industry, starting with the nature of the press and publication industry as a large group and exclusive group. The countermeasures to get out of this dilemma are as follows: selective encouragement to press and publishing institutions, adjustment of market structure and establishment of meta-norms to encourage cooperation.
