著作权法中合并原则及其适用

【摘要】：著作权法中的合并原则与情景原则实际上是为防止思想的垄断而对作品著作权保护的一种限制,在不同类型的作品中,其适用的可能性不同:在虚构作品中,表达方式具有多样性,合并原则与情景原则适用的概率较小;在事实性作品与功能性作品中,表达方式受到多种因素的限制,可能具有唯一性或有限性,合并原则与情景原则适用的概率较大;在视觉艺术作品中是否可能适用合并原则与情景原则的关键在于,用可视的方式表达特定思想时是否存在表达方式之有限性的可能。作品通常表现为思想、架构与最终表达的三元结构,合并原则不仅在最终表达的层面适用,在作品的架构这一层面亦具有适用可能性。
[Abstract]:The combination principle and the situational principle in copyright law are in fact a restriction on the copyright protection of works in order to prevent the monopoly of ideas. In different types of works, the possibility of their application is different: in fictional works, The expression mode is diverse, and the probability of applying the combination principle and the situational principle is small; In factual works and functional works, the expression mode is limited by many factors and may be unique or limited. The key to the possibility of applying the combination principle and the situational principle in visual works of art lies in whether there is the possibility of limited expression when expressing a particular idea in a visual way. The principle of combination applies not only at the level of final expression, but also at the level of the structure of the work.
