论物权合同的独立性——以《物权法》第十五条的解释为中心

【摘要】:物权公示原则应存在例外,登记与否本身并不必然决定物权的有无,不动产登记的目的并非设权,而在于确保稳定有序的物权交易秩序。然而,《物权法》上的善意取得制度足以维护动态物权流转秩序,保障交易安全。基于此,《物权法》第十五条规定的"合同"不宜简单地限定为债权合同,而应在解除物权效力与登记绑定的基础上,承认物权合同的独立性并确认其物权效力,基于法律行为的不动产物权归属应根据有效的物权合同判定。是故,不动产登记权利人并不能当然地对抗已经占有不动产的前买受人。
[Abstract]:There should be exceptions to the principle of real right publicity. Registration itself does not necessarily determine the existence or absence of real right. The purpose of real estate registration is not to establish rights, but to ensure a stable and orderly order of real right transactions. However, the bona fide acquisition system in the Real right Law is sufficient to maintain the order of the circulation of dynamic real right and ensure the transaction security. On the basis of this, the "contract" stipulated in Article 15 of the "Real Law" should not simply be limited to the contract of creditor's rights, but should recognize the independence of the contract of real right and confirm its effect of real right on the basis of releasing the validity of real right from binding with registration. Real property ownership based on legal act should be judged according to valid real right contract. Therefore, the owner of real estate registration right can not naturally confront the former buyer who has already possessed the real estate.
