保障性住房产权设计模式研究

【摘要】:产权型保障房是保障房未来发展的新模式。面对住房制度改革的新常态,将存量商品房转化为保障房已成为理论和实务界的共识。但基于保障房统一立法的缺失加之产权设计模式的差异,导致我国保障性住房普遍存在产权不明、权责不清、流转不畅的问题。在存量房高压背景下,未来产权设计应当以市场为导向,以多元主体为轴心,以产权流转为主线,发挥市场各要素的作用,创新住房社会治理手段,实行政府与社会的合作治理模式。
[Abstract]:Indemnificatory apartment of property right type is the new model of indemnificatory apartment's future development. In the face of the new normal of housing system reform, it has become a consensus in theory and practice to convert the stock of commercial housing into indemnificatory apartment. However, due to the lack of unified legislation of indemnificatory apartment and the difference of the design mode of property rights, the problems of unclear property rights, unclear rights and responsibilities, and poor circulation exist in our country's indemnificatory housing. Under the background of high pressure of stock house, the design of property right in the future should take the market as the guide, take the pluralistic main body as the axis, take the property right circulation as the main line, give play to the function of all the elements of the market, and innovate the means of social governance of housing. Implement the cooperative governance model between government and society.
