药品专利强制许可制度在发展中国家的应用——从“抗癌药代购第一人”陆勇事件谈起

【摘要】："抗癌药代购第一人"陆勇事件引发社会各界的广泛关注,该事件不只涉及刑法问题,其背后透露出的发展中国家完善和实施药品专利强制许可的必要性和紧迫性更值得学界深思。以印度作为发展中国家的代表,通过介绍药品专利强制许可制度在主要发展中国家的发展和实践,反思我国药品专利强制许可制度的现状,并为解决相关问题提出法律和政策思路,以期未来中国能真正建立起符合国情的药品专利强制许可制度。
[Abstract]:The case of "the first person who purchased the first anticancer drug" has aroused widespread concern from all walks of life in the society. This incident involves not only the criminal law issue, but also the issue of criminal law. The necessity and urgency of perfecting and implementing compulsory licensing of drug patents in developing countries revealed behind it is worth thinking deeply. By introducing the development and practice of compulsory licensing system for drug patents in major developing countries, India as a representative of developing countries, this paper reflects on the current situation of compulsory licensing system for drug patents in China. In order to solve the related problems, the author puts forward some legal and policy ideas in order to establish a compulsory licensing system for pharmaceutical patents in the future.
