论商标的在先使用抗辩制度

【摘要】：在新《商标法》修订以前,在先的使用利益并未得到法律的直接肯定。因为我国商标专用权的获得一直采取的为注册原则,先于注册的使用并不会产生任何权利。因此在规定该制度以前,当商标专用权人对在先使用人提起商标侵权诉讼时,能否根据“在先使用”这一事由进行抗辩一直存在激烈的争议。导致在商标专用权人对在先使用人提起的商标侵权案件中,审理的思路和裁量的结果存在很大差别。新《商标法》对在先使用抗辩制度的引用,成功消除了这一司法实践中长期存在的分歧。本文从有关在先使用性质的四种不同学说入手,探讨在先使用的含义,以明确立法中设定在先使用抗辩制度的理论基础。并立足在先使用抗辩制度的法律规定和立法现状,充分对该制度的具体构成要件进行分析。还将立法中易对大家造成混淆的在先使用抗辩制度、在先权利以及驰名商标保护的概念进行区分,以便明确在先使用抗辩制度的适用情形。本文为了将法律理论与实践相结合,行文中采取了案例分析法,通过对引入该制度之前的案件审理情况进行比较,证明规定该制度的必要性。通过列举新《商标法》修订之后适用在先使用抗辩制度的案例,说明在司法实践中存在的法律问题。在先使用抗辩制度在立法时缺少对区别义务承担的相关规定,本文进行了重点论述,分析现行法律的不足并提出了完善建议。
[Abstract]:Prior to the revision of the new Trademark Law, prior use benefits were not directly affirmed by the law. Because the right to exclusive use of trademarks has always been adopted as the registration principle, the use of prior registration will not give rise to any rights. Therefore, before the regulation of this system, when the trademark exclusive right person brought trademark infringement action against the prior user, there has been a fierce dispute as to whether the defense can be made according to the subject matter of "prior use". In the trademark infringement cases brought by the exclusive owner of trademark, there is a great difference between the thinking of trial and the result of discretion in the case of trademark infringement brought by the exclusive right of trademark to the prior user. The new Trademark Law successfully eliminates the long-standing differences in judicial practice by referring to the defense system of prior use. Starting with four different theories on the nature of prior use, this paper probes into the meaning of prior use in order to clarify the theoretical basis of the system of pre-use defences in legislation. And based on the legal provisions and legislative status of the defense system in advance, this paper fully analyzes the specific elements of the system. It also distinguishes the concept of prior use defense system, prior right and well-known trademark protection, which is easy to confuse everyone in the legislation, so as to clarify the application of the prior use defense system. In order to combine the legal theory with practice, this paper adopts the case analysis method, through the comparison of the cases before the introduction of the system, proves the necessity of stipulating the system. This paper illustrates the legal problems existing in judicial practice by enumerating the cases of the first use of the defense system after the revision of the new Trademark Law. In the first use of the defense system in the legislation of the lack of the obligation to bear the relevant provisions, this paper focuses on the discussion, analysis of the shortcomings of the existing law and put forward some suggestions for improvement.
