论我国限定继承制度的完善——以我国台湾地区“民法”继承编为参照

【摘要】：《中共中央关于全面推进依法治国若干重大问题的决定》在加强重点领域立法部分提出,要"编纂民法典"。继承法是民法典的重要组成部分。我国《继承法》第33条确立了限定继承制度,但缺失适用相关条件和程序的规定。因此,在司法实践中难以发挥应有作用。为在我国民法典编纂过程中弥补这一缺憾,文章梳理了我国台湾地区"民法"继承编修订后的规定和学说,根据我国继承法实行近30年来的现实情况,对如何完善我国限定继承制度提出了立法建议。
[Abstract]:In the part of strengthening the legislation in key areas, the CPC Central Committee's decision on promoting some major issues of ruling the country according to law in an all-round way puts forward that it is necessary to "compile the Civil Code." Inheritance law is an important part of civil code. Article 33 of the inheritance Law of our country establishes the limited inheritance system, but lacks the relevant conditions and procedures. Therefore, it is difficult to play its due role in judicial practice. In order to make up for this deficiency in the process of compiling our national code, this paper combs the provisions and theories of the revision of the inheritance of the Civil Law in Taiwan of our country, and puts forward some legislative suggestions on how to perfect the limited inheritance system of our country according to the realistic situation of the inheritance law of our country in the past 30 years.
