海上货物运输保险中的保险利益研究

【摘要】：随着国际贸易经济的逐渐兴起，海上货物运输保险也快速的发展起来，保险利益则无疑成为海上保险中最重要的因素之一。保险利益原则在海上保险的地位日渐重要，而我国目前对保险利益的研究还只是停留在对海运发达国家的相关法律的借鉴上，还没有真正形成统一的理论体系。保险利益对保险合同的效力起到决定性的作用，如果没有保险利益或者超出保险利益的范围，则合同则是无效的，只有在保险利益的合理的期待范围之内才会是有效的。随着我国国际贸易经济的发展和我国法律体系的不断完善，关于保险利益的问题，，在我国的理论界和实务过程中时常会发生争执和误解。因此，我们急需对保险利益的相关问题进行研究和完善，以形成实践和理论的协调发展。在国际贸易经济的大背景下，再依靠我国的《海商法》和新修订的《保险法》的相关法律条文的规定的基础上，对保险利益的具有争议的行的问题进行了详细的阐述和解释。本文的第一章节首先是对保险利益的基本问题进行了阐述，从而为研究海上保险的保险利益的问题打下铺垫；第二章节是对海上货物运输保险中的保险利益的归属问题进行了论述，主要是阐述了保单转让对保险利益的影响和在国际贸易术语下的保险利益的归属问题；第三章则是主要是针对实践中的问题进行了阐述，最后主要说明在实践过程中保险利益的转移对权利人的影响问题；最后一个章节是通过对理论和实务的研究，进而阐述我国的《海商法》和《保险法》上对保险利益的相关问题的不足和缺陷，进而提出自己的建议和意见。
[Abstract]:With the gradual rise of international trade economy, marine cargo transport insurance has also developed rapidly. Insurable interest is undoubtedly one of the most important factors in marine insurance. The principle of insurable interest is becoming more and more important in marine insurance. At present, the study of insurance interests in our country is just to draw lessons from the relevant laws of developed countries in maritime transportation. Insurance interests play a decisive role in the effectiveness of insurance contracts, if there is no insurance interests or beyond the scope of insurance interests, the contract is invalid. With the development of China's international trade economy and the continuous improvement of our legal system, the issue of insurance interests will be effective. Disputes and misunderstandings often occur in the theoretical and practical process of our country. Therefore, we urgently need to study and improve the relevant issues of insurance interests in order to form a coordinated development of practice and theory. Under the background of the international trade economy, we rely on the relevant provisions of the Maritime Law and the newly revised Insurance Law. The first chapter of this paper is about the basic problems of insurance interests. Thus lay the groundwork for the study of the insurance interests of marine insurance; The second chapter discusses the ownership of insurance interests in marine cargo transport insurance, mainly expounds the impact of policy transfer on insurance interests and the attribution of insurance interests under international trade terms; The third chapter is mainly about the problems in practice, and finally explains the impact of the transfer of insurance interests on the obligee in the process of practice. The last chapter is based on the study of theory and practice, and then expounds the deficiencies and defects of the relevant problems of insurance interests in China's Maritime Law and Insurance Law, and then puts forward its own suggestions and opinions.
