国际海上货物运输合同下的诉权问题研究

【摘要】：论文首先对诉权的有关基础理论加以简单的介绍，界定了诉权的概念，明确了诉权与实体权利之间的关系，并对享有诉权所应具备的要件，即当事人适格和诉的利益，进行了分析。接着，，开始探讨国际海上货物运输合同下的诉权归属问题。为了论文后半部分的研究方便，笔者对有关重要概念(托运人、提单持有人和收货人)作了一些探讨，明确我国《海商法》应当如何对其加以界定才能更好的解决实际中因各概念之间界定不清而产生的争议，然后，在此前提下讨论它们各自的诉权问题。接下来是论文的重点，笔者对英国法律有关诉权的规定以及目前作为研究运输合同下诉权发展趋势的代表《UNCITRAL运输法文本文件》中的有关诉权规定进行了研究，然后针对我国现行法律制度下存在的问题，分不可转让运输单证和可转让运输单证两种情况加以分析，最后得出结论，并对修改我国《海商法》的有关内容做出了笔者的建议。
[Abstract]:Firstly, the basic theory of the right to appeal to the simple introduction, defines the concept of right of petition, clarify the relationship between litigation rights and substantive rights, and the elements of right of prosecution should have, namely prozessfuhrungsrecht and rechtsschutzinteresse, are analyzed. Then, discuss on problems of right of ownership to the contract of International Carriage of goods under the sea.
In order to study the second part of this thesis, the author of the convenience of some important concepts (the shipper, consignee and the holder of the bill of lading) are discussed, clearly China Maritime Law > < should how to define in order to better solve the reality because of the unclear definition of the concept between the dispute, then their the right of discussion on this premise.
The following is the focus of the thesis, the author of the British legal provisions and the litigious right now as the development trend of the right of contract of carriage under in the relevant provisions of the right, and then according to our current legal system problems, not negotiable transport document and document transfer two kinds of transportation is analyzed, finally draws the conclusion, and the content of the revision of China's "maritime law > made suggestions.
