论民法文化的发展与商法文化的建设

【摘要】：正众所周知,西方(欧美)的法文化从产生起就以其独特的民法思想贯穿其中,并且始终把民法或称之私法作为根基和主干。这,一方面得益于产生它的那种民主政治的环境,即当时古希腊、古罗马贵族与平民围绕着“权利”这个轴心而展开的斗争的推动;另一方面商品经济在地中海沿岸的充分发展使规范人们之间(特别是本国人与外国人之间)经济利益和商行为的财产法的产生成为必然;最后还必须充分认识到一大批从平民阶层中成长起来的新的商品经济代表的思想家们(主要是法学与哲学家)的对民主政治理论的大力张扬,才使私法
[Abstract]:It is well known that the legal culture of the West (Europe and the United States) has been permeated by its unique thought of civil law since its emergence, and has always taken civil law or private law as its foundation and backbone.This, on the one hand, was facilitated by the democratic political environment in which it was created, namely, the struggle between the ancient Greek, Roman aristocracy and the common people around the axis of "right";On the other hand, with the full development of commodity economy along the Mediterranean coast, it is necessary to regulate the economic interests between people (especially between native and foreigners) and the property law of commercial firms.Finally, we must fully recognize the great publicity of democratic political theory by a large number of thinkers (mainly law and philosophers) who have grown up from the civilian class to represent the new commodity economy, in order to make private law.
