《鹿特丹规则》中海运履约方责任问题研究

【摘要】: 联合国国际贸易法委员会(UNCITRAL)于2008年12月11日通过了《鹿特丹规则》,海运履约方是UNCITRAL《鹿特丹规则》中独具特色的一项法律制度。这一概念的设立,对于澄清复杂的门到门国际海上货物运输法律关系中的责任主体,确定履行承运人义务的参与方的责任,具有重要的理论和现实意义。本文的写作目的就是系统地研究海上履约方的责任制度以帮助应对目前海上货物运输领域法律关系复杂化的现状。 本文共分为三部分: 第一部分概括介绍了海上货物运输中的履约方这一概念产生背景和制定过程,分析了履约方和海运履约方的定义和范围,对承运人之外实际参与海上货物运输过程的其他当事方进行了界定。 第二部分分析了海运履约方的赔偿责任,主要包括责任性质、归责原则和举证责任、责任限制及丧失、赔偿责任的范围和赔偿数额的确定以及海运履约方与承运人的责任关系。 第三部分结合我国目前《海商法》实际承运人制度在理论和司法实践中存在的问题,以及港站经营人的法律地位和责任制度不明确的现状,提出了立法建议。
[Abstract]:The United Nations Commission on International Trade Law (UNCITRAL) adopted the Rotterdam rules on December 11, 2008. The maritime performing party is a unique legal system in the UNCITRAL Rotterdam rules. The establishment of this concept is of great theoretical and practical significance to clarify the subject of responsibility in the complicated legal relationship of door-to-door international carriage of goods by sea and to determine the responsibility of the participants who fulfill the carrier's obligations. The purpose of this paper is to systematically study the liability regime of maritime performing parties in order to help cope with the complicated situation of legal relations in the field of carriage of goods by sea. This paper is divided into three parts: The first part introduces the background and development process of the concept of performing party in the carriage of goods by sea, and analyzes the definition and scope of performing party and maritime performing party. Other parties other than the carrier who are actually involved in the carriage of goods by sea are defined. The second part analyzes the liability of the maritime performing party, including the nature of the liability, the principle of liability and the burden of proof, the limitation and loss of liability, the scope of the liability and the determination of the amount of compensation, as well as the liability relationship between the maritime performing party and the carrier. The third part puts forward some legislative suggestions according to the problems existing in the theory and judicial practice of the actual carrier system of Maritime Law in China, as well as the unclear legal status and liability system of the operators of port stations.
