试论UNCITRAL运输法公约中的海运履约方制度

【摘要】：海运履约方制度是联合国贸易法委员会《全程或部分海上货物运输合同公约》中的新制度。公约最大范围地将参与履行海运段承运人义务的海运履约方纳入公约调整,为海运履约方建立了实质性的赔偿规则,并且规定了承运人与海运履约方间的连带责任。海运履约方制度不同于现行公约和国内法中的制度,我国海商法中的相关制度与之也是有差别的,受公约的影响,未来我国的相关制度将有可能做出一些调整。
[Abstract]:Maritime performing party system is a new system in the UNCITRAL Convention on contracts for the Carriage of goods wholly or partly by Sea. In the convention, the maritime performing party involved in the performance of the carrier's obligations during the period of maritime transport is incorporated into the convention to establish substantive rules of compensation for the maritime performing party, and the joint and several liability between the carrier and the maritime performing party is stipulated. The system of maritime performing party is different from the current convention and the system of domestic law, and the relevant system of maritime law of our country is also different from it. Under the influence of the convention, the relevant system of our country will make some adjustments in the future.
