海运承运人交付货物问题研究

【摘要】:本文的研究对象是海运承运人交货制度。交付货物是货物运输合同下承运人的主要义务之一,也是运输合同的主要目的之一。完成交付是运输合同完成和承运人责任终止的一个典型标志。然而,鲜有法律对交付做出明确规定。交付一般是航运实务中的概念,但交付意味着承运人责任期间的终止,故研究交付制度有重要的法律意义。本文结合海运承运人责任期间研究其交付制度。 全文除引言和结论外分为四个部分。 第一部分是承运人交付货物的概述,简要的从法理上分析了承运人交付货物的义务来源及其性质,明确承运人交付货物是履行运输合同下的债务。之后详细分析了承运人交付货物的要件,就交付的地点、时间和对象进行了一一分析。 第二部分是对货物交付制度的分析界定承运人完成交付的标准。从承运人交付货物是履行其运输合同下债务提出以合同约定为完成交付的首要标准,之后结合责任期间与法理,分析有关货物交付的学说,并就各个学说进行了简要评析,结合各国立法和有关国际货物运输的公约的规定,提出货物交付应为多重标准。 第三部分是从交付的过程的角度分析在不同情形下的货物交付。分一般情形下记名提单和不记名提单的交付,特殊情形下的电放交付与货交港口当局。就这不同情形分别进从法理和操作的角度进行分析。 第四部分分析了承运人交付受阻的情形,结合债务消灭的原理和相关公约与立法,分析在交付受阻的情形下承运人如何免除运输合同下的交付义务终止自己的责任期间。 结论部分结合正文分析内容,对我国《海商法》提出完善交付货物规定的几点建议。
[Abstract]:The object of this paper is the delivery system of sea carrier. Delivery of goods is one of the main obligations of the carrier under the contract of carriage of goods, and also one of the main purposes of the contract of carriage. The completion of delivery is a typical symbol of the completion of the contract of carriage and the termination of the carrier's liability. However, there are few laws that specify delivery. Delivery is generally a concept in shipping practice, but delivery means the termination of the carrier's liability period, so it is of great legal significance to study the delivery system. This paper studies the delivery system of marine carrier during the period of its liability. In addition to the introduction and conclusions, the full text is divided into four parts. The first part is an overview of the carrier's delivery of goods. It analyzes the source and nature of the carrier's obligation to deliver the goods from a legal point of view, and clarifies that the carrier's delivery of the goods is the performance of the obligations under the contract of carriage. After that, the paper analyzes the requirements of carrier delivery, and analyzes the place, time and object of delivery one by one. The second part is the analysis of the delivery system to define the carrier to complete the delivery criteria. From the view that the carrier's delivery of goods is the performance of his obligations under the contract of carriage, the author puts forward that the contract agreement is the primary standard for the completion of delivery, and then, combining the period of responsibility and the legal theory, analyzes the theory of goods delivery, and makes a brief assessment of each doctrine. Combined with national legislation and conventions on international carriage of goods, it is proposed that the delivery of goods should be multiple standards. The third part is to analyze the delivery of goods in different situations from the point of view of the delivery process. Delivery of bearer bill of lading and bearer bill of lading in general, telex delivery and delivery of goods to port authorities in special cases. From the perspective of jurisprudence and operation, this paper analyzes the different situations. The fourth part analyzes the carrier's delivery obstructed situation, combined with the principle of debt extinction and related conventions and legislation, analyzes how the carrier in the delivery of the contract of carriage under the circumstances of the delivery obligations to terminate their liability period. Based on the analysis of the main text, the conclusion part puts forward some suggestions on how to improve the regulations on delivery of goods in Maritime Law of China.
