商事侵权责任对侵权责任法的挑战及其对策

【摘要】：对商事侵权责任制度立法的重视,反映了市场经济的需要,也是现代多元风险社会利益平衡和利益保护的基本要求。寄生于传统侵权法母体中的现代侵权责任法体系,与传统侵权责任法具有共生关系。商事侵权责任制度在传统侵权责任制度的基础上发展起来,以应对现代社会中所涌现的各种新型商事侵权行为。商事侵权责任制度体系的核心是一般条款的构建,这要求我们既要认识到一般化与类型化两种立法技术的差异和相互借鉴的趋势,也要慎重考虑民法与商法的关系。由于新颁布的《中华人民共和国侵权责任法》并未对商事侵权责任作出专门规定,因此应通过修法或出台相关司法解释弥补这一缺憾。
[Abstract]:The emphasis on the legislation of commercial tort liability system reflects the need of market economy and is also the basic requirement of balancing and protecting the interests of modern multi-risk society. The modern tort liability law system parasitic in the traditional tort law has a symbiotic relationship with the traditional tort liability law. The system of commercial tort liability has developed on the basis of traditional tort liability system in order to cope with the emergence of various new types of commercial tort acts in modern society. The core of the system of commercial tort liability is the construction of general clauses, which requires us not only to recognize the differences between general and typed legislative techniques and to draw lessons from each other, but also to carefully consider the relationship between civil law and commercial law. Since the newly promulgated Tort liability Law of the people's Republic of China has not made special provisions on the liability for commercial tort, it is necessary to make up for this shortcoming by amending the law or introducing relevant judicial interpretations.
