【摘要】：目前我国无船承运业务随着国际贸易和航运的发展而蓬勃发展。在无船承运人快速发展的同时，我们也应看到它面临种种风险，而在海上货物运输这一特殊环境中，，这种风险往往是巨大的，很多情况下，会让无船承运人无力承受。为担保这种风险，目前世界上主要有保证、保证金和责任保险的方式，其中最有效的是责任保险。然而，无船承运人责任保险在我国却一直没有出台，原因种种，但最重要的是，我国法律法规中对于无船承运人的概念、法律地位和法律责任没有明确的规定，这使得实践中人们对于无船承运人的含义一直争论不休，更不用说去探究无船承运人责任保险了。因此，本文在借鉴各国有关法律规定的基础上，通过对我国学者观点的比较，首先明确了无船承运人的词意；其次，结合《海商法》等相关法律法规的规定，对无船承运人的法律地位和法律责任进行了剖析；第三，本文分析了目前在我国实行无船承运人责任保险的必要性和可行性，提出在我国建立无船承运人责任保险制度；第四，本文在借鉴国际上一些著名保险公司对于无船承运人责任保险条款内容的基础上，结合我国保险市场的现状，对无船承运人责任保险条款进行了设计；最后，本文分析了我国目前有关无船承运人的法律法规中存在和面临的问题，提出在未来建立我国无船承运人责任保险法律制度的司法建议。
[Abstract]:At present, with the development of international trade and shipping, the non-ship shipping business in China is booming. With the rapid development of NVOCC, we should also see that NVOCC faces all kinds of risks, but in the special environment of carriage of goods by sea, this risk is often enormous, in many cases, it will make NVOCC unable to bear. In order to guarantee this kind of risk, there are main ways of guarantee, margin and liability insurance in the world at present, the most effective of which is liability insurance. However, the liability insurance of NVOCC has not been issued in our country for many reasons, but the most important thing is that the concept, legal status and legal liability of NVOCC are not clearly stipulated in our laws and regulations. This makes people argue over the meaning of NVOCC in practice, let alone explore NVOCC liability insurance. Therefore, on the basis of drawing lessons from the relevant laws and regulations of various countries and comparing the views of Chinese scholars, this paper first clarifies the meaning of the term of NVOCC; secondly, combined with the relevant laws and regulations such as Maritime Law, This paper analyzes the legal status and legal liability of NVOCC. Thirdly, this paper analyzes the necessity and feasibility of implementing NVOCC liability insurance in China, and puts forward the establishment of NVOCC liability insurance system in China. Based on the reference of some famous international insurance companies for the content of the liability insurance clause of NVOCC, combined with the current situation of China's insurance market, this paper designs the NVOCC liability insurance clause. This paper analyzes the problems existing and faced in the current laws and regulations concerning NVOCC in China, and puts forward some judicial suggestions for establishing the legal system of liability insurance for NVOCC in China in the future.
