中国法制现代化进程中的法律移植问题研究

【摘要】：法律移植是比较法学的一个重要的理论和实践问题,它的基本含义是:在鉴别、认同、调适、整合的基础上,引进、吸收、采纳、摄取、同化外国法律(包括法律概念、技术、规范、原则、制度和法律观念等),使之成为本国法律体系的有机组成部分,为本国所用。它是法律的借鉴和吸收,是法律国际化的必然要求。法律移植古来已有。进入20世纪70年代中期,国际上再度掀起了研究法律移植的热潮,并在中国法学理论界和立法部门产生了一定的反响。随着中国法制现代化进程的逐步推进,是否在中国进行法律移植,以及如何移植,就成为摆在我们面前的一个重要课题。本文从历史和现实出发,结合国际国内情况,对法律移植的基本问题,如:法律移植的涵义、要件、法律移植的必然性、法律移植的可能性及法律移植理论的历史演进进行了探讨,并分析了影响法律移植的因素及法律移植成功的条件,同时在对我国法律移植历史回顾的基础上,提出了进行法律移植应遵循的原则,并探讨了在我国进行法律移植时应注意的一些问题。
[Abstract]:Legal transplantation is an important theoretical and practical problem of comparative law. Its basic meaning is to introduce, absorb, adopt, assimilate and assimilate foreign laws on the basis of identification, identification, adjustment and integration, and assimilate foreign laws (including legal concepts, technology, norms, principles, systems and legal concepts, etc.) and make it an organic part of the legal system of the country, It is used for the country. It is the reference and absorption of law. It is the inevitable requirement of the internationalization of the law. The law transplantation has been brought about in the middle of the 1970s. In the middle of the 1970s, the study of legal transplantation has been raised again in the world, and it has produced certain repercussions in the legal theorists and the legislative departments of China. It is an important topic for us to carry on the law transplant in China and how to transplant it. This paper, starting with the history and reality, combined with the international and domestic conditions, has the basic problems of the transplantation of law, such as the meaning of law transplantation, the necessity of the legal transplant, the possibility of legal transplantation and the theory of legal transplantation. The historical evolution is discussed, and the factors affecting the legal transplantation and the conditions for the success of the legal transplant are analyzed. At the same time, on the basis of the retrospect of the history of China's legal transplantation, the principles that should be followed in the law transplantation are put forward, and some problems that should be taken into account in the law transplantation in China are also discussed.
