中国民法经济法论战初考

【摘要】：从1979年8月至1986年春《民法通则》颁布之前的七年间,中国民法与经济法学界围绕民法与经济法的调整对象、经济法是否为部门法问题展开了一场中国法学史所罕见的大论战。经济法理论来源于前苏联,由于在意识形态、所有制和经济体制与中国的高度同质性和政治正确性而在中国迅速崛起并在论战初期占尽了优势;民法由于个人主义的立场和市场取向而在政治上饱受压制并因此在论战的初期尽显被动。但中国的市场化改革决定了民法的复兴,《民法通则》宣示了民法的最终胜利。中国经济法的出路在于抛弃与民商法争夺地盘的思路,增强学术独立性,放弃统制主义的经济法体系。
[Abstract]:From August 1979 to spring 1986, during the seven years before the promulgation of the General principles of Civil Law, the scholars of civil law and economic law in China have launched a rare debate on whether the economic law is a branch of law around the object of adjustment of civil law and economic law. The theory of economic law originated from the former Soviet Union. Because of the high homogeneity and political correctness of ideology, ownership and economic system with China, the theory of economic law rose rapidly in China and occupied the advantage in the early stage of the debate. Civil law was suppressed politically because of individualism and market orientation, so it was passive in the early stage of the debate. However, China's market-oriented reform determines the revival of civil law, and General principles of Civil Law declare the final victory of civil law. The outlet of China's economic law is to abandon the idea of competing with civil and commercial law, to strengthen academic independence and to abandon the system of economic law of domination.
