海上货物运输承运人归责问题研究

【摘要】：承运人责任制度一直以来都是国际海运公约中最有特色的制度之一,尤其是承运人的归责原则更是突出体现了承运人和货方在海上货物运输过程中风险的分担,决定着海上货物运输法的价值取向。近几年来,对于承运人的归责原则到底继续采用《海牙规则》的不完全过错责任原则,还是转而采用完全过错责任原则,一直备受国际海运界的关注,在国际上也褒贬不一,我国《海商法》海上货物运输承运人的归责原则也面临同样的问题。笔者试图以民法上归责原则的由来、归类为基础,从世界目前存在的四大航运公约的归责原则出发,探究我国《海商法》海上货物运输承运人之归责原则的法律问题。
[Abstract]:The carrier liability system has always been one of the most distinctive systems in the international shipping conventions, especially the principle of the carrier's imputation, which embody the risk sharing between the carrier and the cargo in the course of shipping the goods at sea, and determines the value orientation of the maritime transport law. In recent years, the principle of the carrier's responsibility to the carrier has come to the point. To continue to adopt the principle of incomplete fault liability of the "Hague rules" or to adopt the principle of full liability for fault, it has always received the attention of the international maritime circle, and has also been mixed in the world. The principle of liability for the carrier in maritime cargo transportation is also faced with the same problems. Based on the classification of the four major shipping conventions existing in the world, the legal issues of China's Maritime Law > the liability principle of the carrier for the carriage of goods at sea are explored.
