海上事故中公务船法律问题研究

【摘要】:政府公务船作为一类特殊的船舶,,在海事法律关系中同样处于一种特殊的法律地位,具有极其特殊的法律属性。由公务船引发的海上事故不同于陆上事故,也不同于普通的海上事故。船舶碰撞、船舶污染以及由此类事故引发的海难救助行为,属于海商法调整的范围,然而,我国海商法明确排除了用于政府公务目的的船舶的适用,其他国家则要么排除公务船的适用,要么在部分章节中规定适用于政府公务船,相关的国际公约大多也不适用于公务船,目前理论界对公务船的研究也很匮乏。基于此种原因,本文深入研究由公务船引发的海上事故的责任承担和赔偿以及海难救助中与公务船有关的救助报酬等问题,以期为海上事故中与公务船相关的法律问题的研究助以微薄之力。 本文共分为五部分: 第一章:海上事故中涉及公务船的基本法律理论。此部分是本文研究的理论基础,主要介绍何为海上事故、公务船及其与海商法船舶的关系,以及由公务船引发的海上事故的责任问题。 第二章:船舶碰撞中公务船法律问题探究。此部分主要研究公务船在船舶碰撞中的相关法律问题,即侵权责任承担及赔偿、船舶碰撞中的责任限制等问题。 第三章:船舶污染中公务船法律问题探究。此部分主要研究公务船污染海域时的责任承担问题及应采取的相应措施,船舶污染中的责任限制等问题。 第四章:海难救助中公务船法律问题探究。此部分主要研究公务船在海难救助中的法律地位及是否可以获得救助报酬,主管机关从事或者控制的救助作业,以及海难救助中公务船的责任限制等问题。 第五章:结论。此部分是对前述几章的总结,并提出几点立法建议。
[Abstract]:As a special kind of ship, the government ship is also in a special legal position in the maritime legal relationship, and has a very special legal attribute. Marine accidents caused by official ships are different from accidents on land and ordinary accidents at sea. Collision of ships, pollution of ships and salvage of shipwrecks caused by such accidents belong to the scope of the adjustment of maritime law. However, the maritime law of our country explicitly excludes the application of ships used for government official purposes. Other countries either exclude the application of official ships or apply to government official ships in some chapters and most of the relevant international conventions do not apply to official ships. For this reason, this paper deeply studies the liability and compensation of the maritime accident caused by the official ship, and the compensation for the salvage related to the official ship in the salvage at sea. The purpose of this paper is to help the study of legal problems related to official ships in maritime accidents. This paper is divided into five parts: the first chapter: the basic legal theory of the maritime accident involving official ships. This part is the theoretical basis of this paper, mainly introduces what is a maritime accident, the relationship between the official ship and the maritime law ship, and the responsibility of the maritime accident caused by the official ship. Chapter two: legal problems of official ships in ship collision. This part mainly studies the related legal problems in ship collision, such as the liability of tort and compensation, the limitation of liability in ship collision and so on. Chapter three: probe into the legal problems of official ships in ship pollution. This part mainly studies the problem of the responsibility and the corresponding measures to be taken when the public ship pollutes the sea area, and the limitation of the liability in the pollution of the ship and so on. Chapter four: the legal problems of official ships in salvage at sea. This part mainly studies the legal status of the official ship in salvage at sea and whether it can get the reward of salvage, the salvage operation that the competent authorities engage in or control, and the limitation of the liability of the official ship in the salvage. Chapter five: conclusion. This part is a summary of the preceding chapters and some legislative suggestions.
