海上货物运输中无单放货的危害与法律规制

【摘要】:无单放货,作为一个长期困扰航运与海事司法界争议较多的问题,这一问题的严重性与高风险性不言而喻,但在实务操作中义有其必要性,所以无单放货虽然给承运人造成了很大的“伤害”,承运人并不为此而禁绝无单放货。无单放货是指货物到达目的港后,承运人在没有收回正本提单的情况下,将货物实际交付给他人的行为。如今,大部分无单放货行为从本质上讲是因为科学技术的发展与法律的滞后性矛盾引起的,它的发生是因为航运技术的发达,船舶大幅度提速,货物流转速度大幅提高,传统纸质单据的流转速度缓慢,而造成承运人在无奈的情况的无单放货。 由于在航运实践中,无单放货行为还牵涉到各方当事人,因此本文对我国无单放货问题进行了比较系统的分析。首先对无单放货的定义、表现形式、形成原因进行了概述,并对我国无单放货案件实践进行深入调查研究,指出了目前我国无单放货案件的新动向——欺诈性无单放货,并对欺诈性无单放货进行了简单明了的分析,以求得出相关解决办法。同时,本文还研究了我国现有的《海商法》与《海关法》中的冲突以及不完善,以图从二者的联系中寻求解决无单放货问题的办法。在文章的最后提出了自己的一些观点建议。谨希望通过此文,有助于我国立法和司法对于无单放货问题进行更深入的研究,以便使我国航运界正确处理无单放货问题,避免无单放货所产生的风险与损失。
[Abstract]:As a controversial issue in shipping and maritime judicial circles for a long time, it is self-evident that the problem is serious and high risk, but it is necessary in practice. Therefore, the delivery of goods without bill of lading has caused great "harm" to the carrier, and the carrier does not prohibit the delivery of goods without bill of lading. The delivery of goods without documents is the act of delivering the goods to others without recovering the original bill of lading after the goods arrive at the port of destination. At present, most of the undocumented shipping activities are essentially caused by the contradiction between the development of science and technology and the lag of the law. It occurs because of the development of shipping technology, the rapid increase in ship speed, and the substantial increase in the speed of goods circulation. The traditional paper documents flow slowly, which causes the carrier to release the goods without bill in the helpless situation. Because of the parties involved in shipping practice, this paper makes a systematic analysis of the problem of undocumented delivery in China. First of all, the definition, form and cause of undocumented delivery are summarized, and the practice of non-bill delivery in our country is deeply investigated and studied, and the new trend of undocumented delivery in our country is pointed out, that is, fraudulent non-bill delivery. A simple and clear analysis of fraudulent non-bill delivery is carried out to find out the relevant solutions. At the same time, this paper also studies the conflicts and imperfections in the existing Maritime Law and Customs Law in China, in order to seek a solution to the problem of shipping goods without bill from the connection of the two. At the end of the article, some suggestions are put forward. It is hoped that this paper will be helpful to our country's legislation and judicature to conduct more in-depth research on the issue of undocumented delivery, so as to enable the shipping industry of our country to correctly deal with the problem of undocumented delivery, and to avoid the risks and losses arising from the undocumented delivery of goods.
