船舶物权法律适用问题研究

【摘要】: 本文的写作目的是为了研究在船舶物权领域如何正确合理地适用法律以解决现存的法律冲突问题。本文采用的是大陆派与英美派相结合的研究方法。 文章以国际私法的基本概念、原则、制度为基础,结合民法物权理论以及海商法中船舶物权的特殊规定,,概括了在船舶所有权、船舶抵押权、船舶优先权以及船舶留置权领域存在的主要法律冲突,并对船舶物权的识别问题进行了说明。在剖析了各种法律适用原则的利弊得失的基础上,讨论了各种冲突规范所体现的立法价值取向,重点探讨了船舶物权领域最重要的系属公式船旗国法在适用过程中存在的问题。最后总结了我国现行立法中存在的缺憾与不足,并对完善我国《海商法》第14章的有关规定提出了自己的建议。
[Abstract]:The purpose of this paper is to study how to apply the law correctly and reasonably in the field of ship real right in order to solve the existing conflict of laws. This paper adopts the research method of combination of continental school and Anglo-American school. Based on the basic concepts, principles and systems of private international law, combined with the theory of real right of civil law and the special provisions of maritime law, this paper generalizes the ownership of ships and the mortgage of ships. The main conflicts of laws in the field of maritime lien and maritime lien are discussed. On the basis of analyzing the advantages and disadvantages of various principles of legal application, this paper discusses the legislative value orientation embodied in various conflict norms, and emphatically discusses the problems existing in the application process of flag country law, which is the most important formula in the field of real right of ship. Finally, this paper summarizes the shortcomings and deficiencies in the current legislation of our country, and puts forward some suggestions for perfecting the relevant provisions of Chapter 14 of the Maritime Code of China.
