我国航空保险法律问题研究

【摘要】： 航空保险起源于20世纪初,在中国,1974年中国人民保险公司为中国民航出具新中国第一份航空保险单,这是我国民用航空保险的开始。三十多年来,随着我国民用航空运输事业的飞速发展,航空保险的作用也越来越突出。然而,目前人们对航空保险知识的了解非常匮乏,对航空保险法律制度的研究还处于起步阶段。因此,探究航空保险法律关系,建立我国航空保险法律制度就显得尤为必要。本文是对航空保险相关法律问题的尝试性研究,包括绪论、正文和结论三个部分。绪论主要阐明了航空保险法律制度的研究背景、国内外进展情况和本文的研究思路。正文采用比较、综合和理论联系实际的方法,对航空保险的概念进行了理论剖析,得出航空保险是一种综合性保险;对航空保险进行了分类,明确了各险种的内容和责任范围,就当前日益严重的航班延误问题,分析了开发航班延误险法律上的可行性;结合保险法知识,对保险法基本原则在航空保险中的适用问题进行了探讨;最后,借鉴海商法相关法律制度,提出了航空保险合同法律制度的初步构想。通过对航空保险上述几方面法律问题的探讨,勾画出我国航空保险法律制度的基本框架,以期为我国航空保险法律制度的建立和完善提供借鉴。
[Abstract]:Aviation insurance originated in the early 20th century. In China, in 1974, the people's Insurance Company of China issued the first air insurance policy for CAAC, which is the beginning of civil aviation insurance in China. In the past 30 years, with the rapid development of civil aviation transportation in China, the role of aviation insurance is becoming more and more prominent. However, at present, people's understanding of aviation insurance knowledge is very scarce, and the research on aviation insurance legal system is still in its infancy. Therefore, it is particularly necessary to explore the legal relationship of aviation insurance and establish the legal system of aviation insurance in our country. This paper is a tentative study of aviation insurance related legal issues, including introduction, main body and conclusion. The introduction mainly expounds the research background of aviation insurance legal system, the progress at home and abroad and the research ideas of this paper. By using the method of comparison, synthesis and combining theory with practice, this paper makes a theoretical analysis of the concept of aviation insurance, and concludes that aviation insurance is a kind of comprehensive insurance, classifies air insurance, clarifies the content and liability scope of each type of insurance, and analyzes the legal feasibility of developing flight delay insurance in view of the increasingly serious flight delay problem at present. Combined with the knowledge of insurance law, this paper probes into the application of the basic principles of insurance law in aviation insurance. Finally, referring to the relevant legal systems of maritime law, this paper puts forward the preliminary conception of the legal system of aviation insurance contract. Through the discussion of the above legal problems of aviation insurance, this paper outlines the basic framework of the legal system of aviation insurance in China, in order to provide reference for the establishment and perfection of the legal system of aviation insurance in China.
