论选举权的司法救济

【摘要】：公民的选举权与村民等主体的选举权存在差别,前者作为一种基础性的法律权利,应给予其特别的保护与救济。以选举权司法救济制度保护选举权、对选举权进行救济,对于维护宪法尊严,促进宪法实施,实现依法治国理念,解决选举纠纷,深化司法功用、推进法治进程等具有重大意义。目前,我国选举权的救济制度,特别是选举诉讼方面存在诸多缺陷,突出表现在选举权司法救济的范围及体制等方面,具体表现为选举权司法救济定性失当、缺乏专门的管辖机关及具体救济程序设计。我国可适时吸收法治先进国家或地区的有益经验,充实选举权司法救济的内容认识,并对选举诉讼的管辖模式进行借鉴。为更好完善选举权司法救济,有效保护公民的基本权利,应对选举权司法救济的管辖、救济主体、法律责任等进行契合实际需求的构建。

At present, China's voting rights relief system, especially the defects of the electoral litigation, especially in the scope of judicial relief and electoral system, the specific performance of voting rights of judicial relief of qualitative misconduct, lack of jurisdiction and special organs the relief program design. China can timely absorb the useful experience of rule of law in advanced countries or regions, enrich the content of judicial relief to vote, and on election lawsuit jurisdiction mode In order to better improve the judicial relief of voting rights, effectively protect the basic rights of citizens, deal with the jurisdiction of judicial relief of electoral rights, relief subjects, legal responsibilities, etc., it fits the construction of practical needs.
