基于义务视角探析住房权实现之问题与矛盾

【摘要】：住房权属于社会权下的具体权利,其实现需要国际社会、国家和个人承担不同的责任和义务,然而三个层面的不同义务都存在着不同程度的问题与矛盾:国际层面,住房权实体性义务与程序性义务严重不平衡;国家层面,呈现美好理想状态的一般义务与无奈现实之间进行着博弈;个人层面,自我保障与政府阻碍之间不断地拉锯。这些问题与矛盾的存在,昭示着住房权的根本解决更多的是一种进程,而不仅仅是一种建立起来的法律文本结构,其实现在理论上和实践中都还有漫长的路要努力。
[Abstract]:The right to housing belongs to the specific right under the social right, its realization needs the international community, the state and the individual to bear the different responsibility and the duty. However, the three levels of different obligations have different degrees of problems and contradictions: at the international level, the substantial obligations of housing rights and procedural obligations are seriously unbalanced; At the national level, there is a game between the general obligation and the helpless reality. At the personal level, self-protection and government obstacles continue to draw a saw. The existence of these problems and contradictions shows that the fundamental solution of housing rights is more a process. In fact, there is still a long way to go in theory and practice.
