我国农民工子女受教育问题的法理分析

【摘要】:随着我国工业化和城镇化的发展,农民工正是当今中国城市化进程中的产物,作为现代化历史上的一个新概念,是中国在特殊历史时期出现的一个特殊的社会群体,也是向我国工人阶级过渡的新产业工人群体,是我国当前工人阶级中新的有机组成部分。随之而来的农民工子女受教育问题,成为我国教育面临的新情况和新问题,这不仅关系到农民工子女自身的发展,还关系到整个社会的稳定与和谐发展。因此,农民工子女受教育权的实现问题已经受到学界的广泛关注。受教育权是公民一项基本人权。教育是一个社会赖以传授知识和文化遗产以及影响个人社会活动和智力增长的正式机构和组织的总格局。教育是培养新生一代准备从事社会生活的整个过程,也是人类社会生产经验得以继承发扬的关键环节,主要指对适龄儿童、少年、青年进行培养的过程。受教育权的有效实现确保包括行为模式和价值标准在内的知识代代相传,为社会提供符合生产力发展要求和各类人才。受教育权既然是公民的一项基本人权,公民本应该平等的享有入学权会,本应该平等的享有国家为其提供学习的条件和物质帮助。但是随迁农民工子女却未能与城市孩子平等的共同分享教育资源。农民工随迁子女流入地教育处于边缘状态,农民工子女学校教学条件差,其根源是城乡分割的户籍制度、义务教育财政体制过度分权、农民工子女学校得不到政府的有效支持。农民工子女受教育权如何实现,本文将从法理的角度对农民工子女受教育权问题进行讨论,分析农民工子女受教育现状,找出问题的原因所在,提出可操作性对策。
[Abstract]:With the development of industrialization and urbanization in China, migrant workers are the product of the process of urbanization in China today, as a new concept in the history of modernization. It is a special social group that appeared in the special historical period of China, and it is also a new industrial worker group in the transition to the working class of our country. It is a new organic part of the current working class in our country. The education of the children of migrant workers has become a new situation and a new problem in our education, which not only relates to the development of the children of migrant workers themselves. Also related to the stability and harmonious development of the whole society. The realization of the right to education of the children of migrant workers has received extensive attention in academic circles. The right to education is a basic human right of citizens. Education is a society that imparts knowledge and cultural heritage and influences individual social activities and intelligence. The overall pattern of formal institutions and organizations that grow. Education is the whole process of preparing the new generation to engage in social life. Also is the human society production experience can inherit and carry forward the key link, mainly refers to the school age children, the youth. The process of youth development. The effective realization of the right to education ensures that knowledge, including behavioural patterns and values, is transmitted from generation to generation. The right to education is a basic human right of citizens, and citizens should have equal access to school. Should have equal access to the state to provide them with the conditions for learning and material assistance. But migrant children and urban children did not share the same educational resources. Status. The poor teaching conditions for the children of migrant workers are rooted in the urban-rural household registration system and the excessive decentralization of the compulsory education financial system. The school of children of migrant workers can not be effectively supported by the government. How to realize the right to education of children of migrant workers, this article will discuss the right to education of children of migrant workers from the perspective of legal theory. This paper analyzes the present situation of the education of the children of migrant workers, finds out the causes of the problems, and puts forward operational countermeasures.
