论住房权及其立法保障

【摘要】：在人权发展史上,有"消极权利"和"积极权利"之分。启蒙运动所提出的以个人自由和财产权为核心的自然权利,即"第一代人权"概念,属于消极权利。第二代人权是二战后西方国家承认的经济、社会和文化的权利,人们又称第二代人权为积极权利。第二代人权包括:社会安全的权利、工作权和休息权、受教育的权利、生活保障的权利、参与文化生活的权利等。住房权作为第二代人权被国际公约提出后,受到各国的普遍重视和立法保障,成为政府的法定义务。近年来,随着我国住房市场化的过度推进,对于中低收入阶层的住房保障严重缺位,故应该加强对住房权的重视和立法保障。
[Abstract]:In the history of human rights, there are negative rights and positive rights. The concept of "first generation human rights" proposed by the Enlightenment as the core of individual freedom and property rights is a negative right. The second generation of human rights is the economic, social and cultural rights recognized by western countries after World War II, and it is also called the second generation of human rights as positive rights. The second generation of human rights include: the right to social security, the right to work and rest, the right to education, the right to life security, the right to participate in cultural life, and so on. Housing right, as the second generation of human rights, has become the legal obligation of the government. In recent years, with the excessive promotion of housing marketization in China, housing security for the middle and low income class is seriously lacking, so we should pay more attention to housing rights and legislative protection.
