【摘要】：本文以地方性法规清理制度为主题，通过对我国地方性法规清理的必要性、清理工作中问题的分析，，提出了对我国地方性法规清理工作进行完善的路径建议。本文认为，地方性法规清理是解决我国地方性法规与上位法之间冲突、地方性法规之间不协调以及地方性法规不适应地方经济社会发展等问题的重要手段，有利于我国法律体系更加科学与统一。本文共分三部分：第一部分介绍了地方性法规清理的概念、特征、清理方式及清理的必要性。分析了地方性法规清理及其与相关概念的区别，将地方性法规清理分为事前清理与事后清理、集中清理与专项清理、定期清理与不定期清理等方式，对其之间的优劣加以比较分析以及从多方面出发指出地方性法规清理的必要性。第二部分是对地方性法规清理缺陷及其成因的分析。目前，在我国地方性法规清理工作主要存在如下缺陷：过度依赖不定期清理、清理标准不清晰、清理工作与相关制度互动不足以及公众参与不足。之所以存在这些问题，主要是因为定期清理机制缺失、缺乏统一的清理标准、主动清理不足、清理信息公开不充分及公众参与实效不足等。第三部分探究了地方性法规清理工作的完善途径。鉴于我国清理工作的现状，应当建立定期清理的长效机制、建立清晰的清理审查标准、实现地方性法规清理与相关制度良性互动以及完善地方性法规清理过程中的公众参与。以多种机制的完善，来保障地方性法规清理工作的有效开展。
[Abstract]:This paper takes the system of clearing local laws and regulations as the theme, through the analysis of the necessity of cleaning up the local laws and regulations and the problems in the clean-up work, and puts forward some suggestions on how to perfect the clean-up work of the local laws and regulations of our country. This paper holds that the cleaning up of local laws and regulations is an important means to solve the conflicts between local laws and laws, the incoordination between local laws and regulations, and the inadaptability of local laws and regulations to the development of local economy and society. It is beneficial to our legal system to be more scientific and unified. This paper is divided into three parts: the first part introduces the concept, characteristics, cleaning methods and the necessity of cleaning local laws and regulations. This paper analyzes on the difference between the local regulation cleanup and its relative concepts, and divides the local regulation cleanup into pre-cleaning and after-cleaning, centralized clean-up and special clean-up, periodic clean-up and irregular clean-up, etc. The advantages and disadvantages between them are compared and analyzed, and the necessity of clearing up local laws and regulations is pointed out from various aspects. The second part is the analysis of the defects of local laws and regulations and their causes. At present, there are some defects in the clean-up of local laws and regulations in China, such as excessive dependence on irregular cleaning, unclear cleaning standards, insufficient interaction between clean-up work and related systems, and insufficient public participation. These problems are mainly due to the lack of regular cleaning mechanism, the lack of uniform cleaning standards, the lack of active cleaning, the inadequate disclosure of cleaning information and the insufficient effectiveness of public participation, etc. The third part explores the perfect ways to clean up the local laws and regulations. In view of the present situation of cleaning work in our country, we should establish a long-term mechanism of regular cleaning, establish clear standards for cleaning up and review, realize benign interaction between cleaning up local laws and regulations and improve public participation in the process of cleaning up local laws and regulations. To improve the various mechanisms to ensure the effective implementation of the work of cleaning up local laws and regulations.
