论我国新闻自由的法律保障

【摘要】：新闻自由作为西方核心价值理念之一,自首次被提出已有三百多年的历史了。三百多年来,关于要不要新闻自由和有没有新闻的争论一直没有停止过。何为新闻自由；西方国家的新闻自由是否是伪新闻自由；新闻自由应该遵循怎样的界限；我国的新闻自由的立法现状如何；我国新闻自由现在面临着哪些问题与困境,又要如何解决；西方国家的成熟经验是否能被我们国家所借鉴,我们又该如何借鉴?本文在论述中一一剖析了这些问题。 新闻自由在本质上是对公民知情权和表达权的保障。一个国家对于新闻自由的保障程度,体现了一国民主政治发展程度和对公民人权和自由的尊重程度。随着经济的飞速发展,我国的大众传播业也得到了高速的发展,政府、媒体和广大民众越来越重视新闻自由。但是目前我国新闻自由存在着较多的问题和困境,分析我国新闻自由存在问题的原因,主要有立法滞后、对媒体权力的保障机制不健全、对媒体监督机制不健全等问题。要进一步保障完善我国的新闻自由制度,除了借鉴国外较为成熟的经验之外,更重要的是探讨出符合我国国情的新闻自由的保障方法。要进一步保障完善我国的新闻自由,首先要强化新闻自由并非绝对自由的观念,明确新闻自由有一定的界限和限制的；除此之外,还要明确宪法对新闻自由的保障作用；制定、颁布专门新闻法；完善新闻自由的司法保障,实现媒体自律、行政监管与法律调控的有机相结合。
[Abstract]:As one of the core values of the West, freedom of the press has been put forward for more than 300 years. For more than three hundred years, the debate about press freedom and press has not stopped. What is the freedom of the press; whether the freedom of the press in the Western countries is a false freedom of the press; what kind of boundaries should be followed for the freedom of the press; what is the status quo of the legislation on the freedom of the press in our country; what problems and dilemmas are facing the freedom of the press in our country now, How to solve the problem; can the mature experience of the western countries be used for reference by our country, and how should we learn from it? This paper analyzes these problems one by one in the discussion. Freedom of the press is essentially the guarantee of citizens' right to know and express. The degree of guarantee of a country's freedom of the press reflects the degree of democratic political development and respect for the human rights and freedoms of its citizens. With the rapid development of economy, the mass communication industry in our country has been developing rapidly. The government, the media and the general public pay more and more attention to the freedom of the press. However, there are many problems and difficulties in press freedom in our country at present. The main reasons for the problems are legislation lag, the guarantee mechanism of media power is not perfect, the supervision mechanism of media is not perfect and so on. In order to further guarantee and perfect the system of press freedom in our country, in addition to drawing lessons from the more mature experience of foreign countries, it is more important to explore the guarantee methods of press freedom in accordance with the national conditions of our country. In order to further safeguard and improve the freedom of the press in our country, first of all, we must strengthen the idea that freedom of the press is not an absolute freedom, and make it clear that there are certain limits and limitations to freedom of the press. In addition, we must also make clear the role of the Constitution in safeguarding the freedom of the press. Promulgate the special press law, perfect the judicial guarantee of press freedom, realize the media self-discipline, the organic combination of administrative supervision and legal regulation.
