【摘要】：近半年多来,由检察机关提起的环境行政公益诉讼逐渐进入人们的视野,并获得了广泛的关注。一系列现实案件使人们对由检察机关提起的环境行政公益诉讼有了更加直观、生动的认识。但这一制度背后的法律依据问题,值得进行更为深入的研究和探讨。本文将从实践中的案例出发,对检察机关进行环境行政公益诉讼的理论基础、潜在的法律基础以及法律依据和实践基础进行分析与研究,旨在对检察机关进行环境行政公益诉讼的法律规制问题进行探索和构建。
[Abstract]:Nearly half a year ago, filed by prosecutors of environmental administrative public interest litigation has gradually entered people's vision, and has gained extensive attention. A series of practical cases so that people in the filed by prosecutors of environmental administrative public interest litigation has a more intuitive and vivid understanding. But this system behind the problem of legal basis, is worth more in-depth research and study. This article will start from the case in practice, the theoretical basis of the procuratorial organs of environmental administrative public interest litigation, analysis and study of the potential legal basis, legal basis and practical basis, aims at the problems of legal regulation of environmental administrative public interest litigation of the procuratorial organs to explore and construct.
