促进我国环保组织发展的法律思考

【摘要】：环保组织是旨在保护生态环境、促进人与自然和谐相处的非营利性组织,其在环境权利救济、促进环保领域的公众参与以及环保意识、文化的培育方面发挥着极其重要的作用。当前我国公民意识(参与意识、规则意识)的淡薄、国家管控理念以及环保组织立法体系的不完善(法律位阶较低、行政规范冗杂且不成体系)制约着我国环保组织的发展。借鉴美国、日本等国家发展环保组织的有益经验,比如,在观念上对公共权利的注重,以及法律制度上对环保组织给予的充分保障,提出:促进我国环保组织发展,首先,应从培养公民意识及转变国家管控理念入手,其次,制定《社会组织法》以均衡环保组织在内的社会组织的权利义务、定制各类保障措施,如,志愿者优待、政府购买服务等制度。
[Abstract]:Environmental protection organization is a non-profit organization which aims to protect the ecological environment and promote the harmony between man and nature. Its environmental rights relief, public participation and environmental awareness in the field of environmental protection are promoted. The cultivation of culture plays an extremely important role. At present, the citizen consciousness (participation consciousness, rule consciousness) is weak, the concept of national control and control and the legislation system of environmental protection organization are not perfect. Administrative norms jumbled and not systematic) restrict the development of environmental protection organizations in China. Learn from the United States, Japan and other countries to develop the beneficial experience of environmental protection organizations, for example, in the concept of public rights. As well as the legal system to provide adequate protection for environmental organizations, put forward: to promote the development of environmental organizations in China, first, we should start with the cultivation of civic awareness and change the concept of state control and control, and secondly. The social organization law is formulated to balance the rights and obligations of social organizations including environmental protection organizations, and to customize various safeguards, such as preferential treatment for volunteers, government purchase of services, and so on.
