【摘要】：目前,我国的农民虽享有宅基地使用权及其上房屋所有权,但其流转权利形同虚设,解决此类问题的法律法规的缺失导致农村宅基地房流转纠纷层出不穷,并且在实务中出现同案不同判的尴尬,农民的私有财产权利得不到切实保护,难免为司法实践带来了新的困扰和问题,存在较大的社会问题隐患。在此背景下,本文梳理农村房屋流转合同纠纷存在的法律问题,对本案中农村宅基地房形成与流转的制度因素进行分析,以本案例中的突出问题为线索,分析宅基地房买卖合同效力的争议所在,通过综合分析强制性规定的认定理论并借鉴上海和北京两地的实务创新,对比两份文件在实务操作上的优势与不足并提出具体的解决思路,在此前提下对农村宅基地房流转的制度建设提出一点浅见和展望。
[Abstract]:At present, although the peasants in China enjoy the right to use the homestead and the ownership of the house, but the right of circulation is virtually empty, the lack of laws and regulations to solve this kind of problems leads to endless disputes over the circulation of rural homestead. And in practice, the embarrassment of different judgments of the same case, farmers' private property rights can not be effectively protected, inevitably for the judicial practice has brought new problems and problems, there are larger social problems. In this context. This paper combs the legal problems existing in the contract dispute of rural housing circulation, analyzes the institutional factors of the formation and circulation of rural house housing in this case, taking the outstanding problems in this case as the clue. This paper analyzes the disputes over the validity of the contract for the purchase and sale of homestead houses, and draws lessons from the practical innovations of Shanghai and Beijing through the comprehensive analysis of the identification theory of mandatory provisions. This paper compares the advantages and disadvantages of the two documents in the practical operation and puts forward some concrete solutions. On this premise, it puts forward some views and prospects for the system construction of the rural homestead house circulation.
