【摘要】：正相对于传统行政法而言,风险行政法是一个应对风险社会的特别机制。本文拟以食品安全法、核能安全法等为主要参照领域,考察风险规制的行政机关设置情况,探究风险行政的组织法构造。这些较成熟领域的经验总结或可成为风险行政组织法的理论基础,指导其他尚处起步阶段的制度设计。风险规制与风险行政组织的基本要求风险规制是应对风险社会的重要方式之一。为了适应风险的特性,风险行政在组织上不仅要遵循传统行政的一
[Abstract]:Is relative to the traditional administrative law, administrative law is a special risk mechanism in a risk society. This paper is intended to the food safety law, nuclear safety law as the main reference field, set on risk regulation of the administrative organ, the administrative organization structure of risk. The mature field of experience or can be the theoretical basis of risk administrative organization law, the other is guidance system design of the initial stage. The basic requirements of risk regulation and risk administrative organization risk regulation is one of the important ways to deal with the risk society.
