【摘要】：房屋使用安全事关广大人民群众生产生活中最普遍、最基础、最直接的利益和安全,事关经济社会发展成果的巩固和延续,事关社会和谐稳定、长治久安的大局。加强城市房屋使用安全管理应该重视城市房屋使用安全管理的立法研究,密切联系现实社会房屋使用安全出现的实际问题,把管理的重心从行政管理转向立法管理。现存的关于房屋安全管理的立法还仅仅限于2部部门规章和各地地方政府规章,而随着城市房屋使用年限的增长,房屋产权多元化的发展趋势,城市房屋使用安全形势发生了新的变化,面对现今的房屋使用安全的严峻形势,制定一部全国性的城市房屋使用安全管理法已迫在眉睫。本文拟构建一部全国性的城市房屋使用安全管理法。本文第一部分主要介绍城市房屋使用安全管理的基本问题,城市房屋使用安全管理的基本理论、发展历程与现状以及存在的问题。对我国城市房屋使用安全管理形成一些基本的认识,深入分析我国城市房屋使用安全管理制度存在的问题,为后文对我国城市房屋使用安全管理法制建设的讨论作铺垫。本文第二部分着重对我国城市房屋使用安全管理立法的必要性和可行性两方面进行分析和探讨。我国城市房屋使用安全管理立法是符合我国依法治国基本国策和社会现实需要的,是在相关国策和已有的立法为基础的前提下进行的,我国城市房屋使用安全管理立法具有必要性和可行性。本部分结合法条、案例、调研报告和国外的先进制度进行详细的分析。本部分已有相关文章进行论述,但笔者拟对其进行更为具体的分析与总结。本文第三部分,拟构建《中华人民共和国城市房屋使用安全管理法》,对《城市房屋使用安全管理法》的定位、原则和基本框架进行一定的构想。本部分主要在对已有的有关城市房屋使用安全管理的法律法规和现今的城市房屋使用安全新形势进行分析总结的基础上进行讨论,力求对《城市房屋使用安全管理法》进行基本的定位。本文第四部分,将讨论完善《中华人民共和国城市房屋使用安全管理法》中的具体制度设计。针对我国城市房屋使用安全管理工作中存在的问题,在具体的制度设计时应就面临的现实问题进行全方位的完善,如危旧房屋申报制度中的申报比例问题、房屋鉴定费用承担主体不明确问题以及房屋使用安全管理部门的职责不明确问题等。本文第五部分,对整篇文章进行总结。
[Abstract]:The safety of housing use is related to the most common, basic and direct interests and security in the production and life of the broad masses of the people, the consolidation and continuation of the achievements of economic and social development, and the harmony and stability of the society. To strengthen the safety management of urban housing use, we should pay attention to the legislative research on the safety management of urban housing use, and closely relate to the practical problems of the safety of housing use in the real society. The existing legislation on housing safety management is limited to only two departmental regulations and local government regulations, and with the increase of the useful life of urban housing. With the development trend of housing property rights diversification, new changes have taken place in the security situation of urban housing use, facing the severe situation of housing use safety nowadays. It is urgent to formulate a national law on the safety management of the use of urban buildings. This paper intends to construct a national law on the safety management of the use of urban buildings. The first part of this paper mainly introduces the basis of the safety management of the use of urban buildings. This question. The basic theory, the development course and the present situation and the existing problems of the safety management of urban housing use have formed some basic understanding on the safety management of the use of urban housing in our country. Deeply analyze the problems existing in the safety management system of urban housing use in China. The second part of this paper focuses on the necessity and feasibility of the legislation on the safety management of urban housing in China. The legislation on the safety management of housing use in national cities is in line with the basic national policy of governing the country according to law and the needs of social reality. It is carried out on the basis of relevant national policies and existing legislation. It is necessary and feasible to legislate on the safety management of urban housing use in our country. Research report and advanced systems abroad for detailed analysis. This part has been discussed in relevant articles, but the author intends to carry out more specific analysis and summary. The third part of this article. This paper intends to construct the "Law of the people's Republic of China on the Safety Management of the use of Urban Housing" and the orientation of the Law on the Safety of the use of Urban buildings. This part is mainly based on the analysis and summary of the existing laws and regulations on the safety management of urban housing use and the new situation of the safety of urban housing use. On. Try to make a basic positioning of the Law on the Safety Management of Urban Housing use. Part 4th of this paper. This paper will discuss how to perfect the specific system design of the Law of the people's Republic of China on the Safety Management of the use of Urban Housing, aiming at the problems existing in the management of the safety of the use of urban buildings in China. In the specific design of the system should be faced with the reality of the improvement of all aspects, such as the problem of the proportion of the declaration of the dangerous old house declaration system. The main body of the house appraisal fee is not clear and the responsibility of the building safety management department is not clear. Part 5th of this paper summarizes the whole article.
