当代中国科研人员职业伦理法律化研究

【摘要】：现代科学技术的迅速发展,推动了人类社会的进步,同时也刺激了人类社会对科学技术更大的需求。而科研人员作为科技发展的拓路者,在满足这些殷切需求的整个研发过程中,往往伴随着责任与诚信的考验：一方面,科学研究给生命、环境与社会带来难以预知的生态风险；另一方面,科学研究所带来的财富与利益,使部分科研人员的功利心理极易诱发科研不端行为。在第三次科技革命的全球化浪潮中,中国已然成为世界科研大国。但我们必须看到在科研人员职业伦理规范建设方面,我国的法规、政策和教育培训都尚处于起步阶段,与发达国家相比存在很大差距；而当下我国科研活动中伦理问题形势严峻,学术造假、有违生命伦理的研究等问题层出不穷,亟待整饬。法律的正义要求科研人员具有崇高的伦理道德,要求科研人员作为科研职业共同体的组成部分承载维护人类生命与财富的价值追求。本文通过提出科研人员职业伦理法律化这一命题,在整合中外科研人员职业伦理法律化理论研究的基础上,结合我国当前科研人员职业伦理现状,剖析当代中国科研人员职业伦理存在的问题,分析当代中国科研人员职业伦理法律化的必要性与可行性,试提出针对科研不端行为与科研活动诱发伦理风险的解决路径,为法律化的实践提供理论上的支持。实现科研职业服务公众利益、科研人员遵守法律的精神追求,塑造科研职业的良好形象和科研人员的优秀品质；实现对当代中国科研人员负责、诚信科研的规范与引导,推动科技法治秩序的逐步形成。
[Abstract]:The rapid development of modern science and technology, promote the progress of human society, but also stimulate the human society to the greater demand for science and technology. In the whole research and development process of satisfying these ardent demands, it is often accompanied by the test of responsibility and honesty: on the one hand, scientific research brings unpredictable ecological risks to life, environment and society; On the other hand, the wealth and benefits brought by scientific research make the utilitarian psychology of some scientific research personnel easy to induce scientific research misconduct. China has become a great scientific research country in the world, but we must see that the regulations, policies and education and training of scientific research personnel are still in their infancy. There is a big gap with developed countries; However, the current situation of ethical issues in scientific research activities in China is grim, academic fraud, contrary to the study of life ethics and other issues emerge one after another, and need to be rectified. The justice of the law requires the scientific research personnel to have lofty ethics. As a component of the scientific research professional community, scientific research personnel are required to carry the value pursuit of safeguarding human life and wealth. This paper puts forward the proposition of legalization of professional ethics of scientific research personnel. On the basis of integrating the theoretical research on the legalization of professional ethics of Chinese and foreign scientific research personnel and combining with the present situation of professional ethics of scientific research personnel in China, this paper analyzes the problems existing in the professional ethics of scientific research personnel in contemporary China. This paper analyzes the necessity and feasibility of the legalization of professional ethics of Chinese scientific research personnel, and puts forward the solutions to the ethical risks induced by scientific research misconduct and scientific research activities. To provide theoretical support for the practice of legalization, to realize the scientific research profession to serve the public interests, to follow the spiritual pursuit of the law, to shape the good image of the scientific research profession and the excellent quality of the scientific research personnel; In order to promote the rule of law of science and technology, we should be responsible for the scientific research personnel in contemporary China and guide the scientific research in good faith.
