乳品安全监管的立法探析

【摘要】：当今社会,乳品已经成为人们日常生活不可或缺的食品,婴幼儿乳品更是影响着下一代的健康成长。因此,对乳品安全监管的重视度不言而喻。然而,近年来我国发生的很多乳品安全事件表明,在乳品生产、加工、流通和消费的各个环节都已出现了对其进行监管的严峻考验。结合各国的监管情况,对乳品这一关乎公众生命健康的行业须通过立法的形式,将监管主体以及具体的监管措施予以确定,并在监管活动中有效地执行。本文将围绕这两个核心问题进行探析,即由“谁”来监管以及采取何种“标准”来监管。本文将首先介绍乳品安全监管立法的相关概念及理论基础；紧接着会对我国乳品安全监管的立法现状以及存在的问题进行分析,问题主要体现在三个方面：相关法律法规体系不完善,现有乳品安全监管主体设置不合理,法律法规的具体内容存在缺陷；然后介绍国外具有代表性的国家(地区)的乳品安全监管经验,它们分别是美国、欧盟、新西兰,并从中总结出国外乳品安全监管经验对我国的启示。针对这些问题,本文最后一章提出了相应的完善建议。在完善相关的法律法规体系方面,提出应着力改善现有法律法规的系统性、协调性较差以及滞后性的现状。对完善我国乳品安全监管主体的设置,提出要进一步整合并明确监管部门的职责；同时完善协调机构的作用和职责。对于如何完善现有法律法规的具体内容,本文提出了五点建议：一、提高现有乳品安全法律法规的具体化程度；二、加重乳品企业的违法成本；三、完善乳品安全法律监管的标准、认证以及检验检测体系；四、完善乳品安全的行政问责以及信息披露制度；五、建立严密的乳品安全追溯机制。在研究方法上,本文主要采用了文献调查分析法,比较分析法,以及理论与实证相结合的研究方法。通过这篇论文,希望能为完善我国的乳品安全监管立法尽绵薄之力。
[Abstract]:Nowadays, dairy has become an indispensable food in people's daily life, and infant dairy is affecting the healthy growth of the next generation. Therefore, the importance of dairy safety supervision is self-evident. In recent years, many dairy safety incidents in China show that in dairy production, processing, circulation and consumption of each link has been a severe test of its supervision, combined with the regulatory situation in various countries. The dairy industry which is related to the life and health of the public must pass legislation to determine the main body of supervision and specific regulatory measures. And effective implementation in regulatory activities. This paper will focus on these two core issues. That is "who" to supervise and what kind of "standard" to supervise. This article will first introduce the relevant concepts and theoretical basis of dairy safety supervision legislation; Then it will analyze the current situation and existing problems of dairy safety supervision in China. The problems are mainly reflected in three aspects: the relevant laws and regulations system is not perfect, the existing dairy safety supervision main body is unreasonable. The specific contents of laws and regulations have defects; Then introduces the representative countries (regions) of dairy safety supervision experience, they are the United States, the European Union, New Zealand. And summed up from the experience of foreign dairy safety supervision and control of China's enlightenment. In view of these problems, the last chapter of this paper put forward the corresponding improvement suggestions in improving the relevant laws and regulations. The author points out that the present situation of systematization, poor coordination and lag of existing laws and regulations should be improved. To perfect the establishment of the main body of dairy safety supervision in China, it is necessary to further integrate and clarify the responsibilities of the supervision department. At the same time, improve the role and responsibilities of the coordinating body. For how to improve the specific content of existing laws and regulations, this paper puts forward five suggestions: first, to improve the specific degree of existing dairy safety laws and regulations; Second, increase the illegal cost of dairy enterprises; Third, perfect the standard of legal supervision of dairy safety, certification and inspection system; Fourth, improve the administrative accountability and information disclosure system of dairy safety; Fifth, the establishment of strict dairy safety traceability mechanism. In the research methods, this paper mainly uses the literature survey analysis, comparative analysis, and the combination of theory and empirical research methods. Through this paper. Hope to improve our dairy safety regulatory legislation to make a modest contribution.
