我国行政备案制度研究

【摘要】：行政备案制度作为相对缓和的政府规制手段,被广泛运用到日常行政管理中,在现代行政中扮演着愈来愈重要的角色。然而目前我国的行政备案制度建设仍然不成熟,学界对行政备案制度的研究成果并不丰硕,尚未在法律规范性文件中给行政备案下一个明确的定义,理论研究不能与实践发展有效对接,行政备案应有价值没有得到最大限度发挥。在此背景下,本文以行政备案制度的研究为选题,在厘清行政备案制度相关理论的前提下,探讨完善我国行政备案制度的具体方法。文章共分为四部分。第一部分从宏观上梳理了行政备案制度的基本概念,从理论上对行政备案的内涵进行了界定,探讨了行政备案的分类、构成,在此基础上,通过对行政备案与行政审批、行政许可、行政确认等类似制度的比较,分析了行者备案制度与类似相关制度的区别,提出了在实践中应严格把握行政备案的内涵和范围,避免以行政备案之名进行行政许可之实的观点。文章第二部分从外部行政备案与内部行政备案两个角度详细阐述了我国行政备案制度存在的问题,这些问题集中体现在外部行政备案报送方式单、审查期限缺乏明确规定;内部行政备案审查主体模糊、机构不健全等方面。文章第三部分采用案例分析法,结合实践中与行政备案制度相关的典型案例,分析行政机关在实施行政备案过程中存在的误区和问题,从而为完善我国行政备案制度提供实践支撑。文章第四部分以解决问题为核心,在第三部分论述了我国行政备案制度存在诸多问题的前提下,提出了从外部行政备案和内部行政备案两方面对我国行政备案制度进行细化的完善,具体包括通过丰富行政备案报送方式、明确行政备案处理期限等方式去完善外部行政备案制度;通过明确审查主体、健全审查机构等方式完善内部行政备案制度。
[Abstract]:As a relatively relaxed means of government regulation, the administrative filing system is widely used in daily administration. It plays a more and more important role in modern administration. However, at present, the construction of administrative filing system in China is still immature, and the academic research on administrative filing system is not fruitful. There is no clear definition of administrative filing in the legal normative documents, the theoretical research can not be effectively connected with the development of practice, and the due value of administrative filing has not been maximized. This paper takes the research of administrative filing system as the topic, under the premise of clarifying the relevant theories of administrative filing system. The article is divided into four parts. The first part combs the basic concept of the administrative filing system from the macro point of view, and defines the connotation of the administrative record system in theory. This paper discusses the classification and composition of administrative record, and on this basis, compares the administrative record with administrative examination and approval, administrative license, administrative confirmation and other similar systems. This paper analyzes the differences between the record filing system and similar related systems, and puts forward that the connotation and scope of administrative filing should be strictly grasped in practice. The second part of the article from the external administrative record and the internal administrative record two angles elaborated in detail our country administrative record system existence question. These issues are concentrated in the external administrative filing and submission form, the review period is not clear provisions; The third part of the article adopts the case analysis method combined with the typical cases related to the administrative filing system in practice. This paper analyzes the misunderstandings and problems existing in the implementation of administrative filing by administrative organs, thus providing practical support for perfecting the administrative filing system in our country. Part 4th focuses on solving problems. In the third part of the administrative record system in China on the premise of the existence of many problems, put forward from the external and internal administrative record two aspects of administrative filing system to refine the perfection of our administrative filing system. It includes perfecting the external administrative filing system by enriching the administrative filing and sending ways, defining the administrative filing processing time limit and so on. The internal administrative filing system should be improved by clarifying the subject of examination and perfecting the examination organization.
