高等学校行政争议非诉解决机制研究

【摘要】：高校与教师、学生之间发生的公法性质争议是高等学校行政争议的核心,也是我国高等教育领域纠纷的核心。我国现有的高等学校纠纷解决机制存在诸多弊端,应当建构高校纠纷的多元解决机制,尤其要健全校内申诉、教育行政申诉和教育人事仲裁等非诉纠纷解决机制,在法律上明确这些救济机制各自的审理范围和幅度、彼此之间的关系以及与行政复议和行政诉讼之间的衔接。
[Abstract]:The dispute on the nature of public law between colleges and universities, teachers and students is the core of administrative disputes in colleges and universities, and also the core of disputes in the field of higher education in China. It is necessary to construct a pluralistic mechanism for resolving disputes in colleges and universities, especially to perfect the non-litigation dispute resolution mechanisms such as appeals in schools, educational administrative appeals and educational personnel arbitration, so as to clarify the scope and scope of each of these relief mechanisms in law. The relationship between each other and the connection between administrative reconsideration and administrative litigation.
