受教育权纠纷解决途径完善

【摘要】:教育,既是公民发展的前提条件,也是国家发展的动力源泉。现代社会,受教育权在许多国家已经是一项基本权利,1我国《宪法》第46条也明确规定了公民有受教育的权利。随着社会的进步和国家的发展,教育正日益成为个人发展的重要因素,受教育也因此受到社会的广泛关注,因公民受教育权引起的纠纷也逐年增多。但囿于理论上的争议及法律救济制度的不完善,纠纷未能得到有效解决。为了充分保障公民受教育的权利,本文从受教育权的本质入手,明确受教育权纠纷的概念及特征,在此基础上对受教育权纠纷的种类进行划分。进而对受教育权纠纷的具体案例进行考证,剖析受教育权纠纷解决中存在的问题。最后,对现有理论的反思与改造,提出完善受教育权纠纷解决途径的措施。 本文除了引言之外,共分为五个部分: 第一部分以受教育权的本质作为研究入口,在总结受教育权本质和内容的基础上,明确受教育权纠纷的概念及特征。进而对受教育权纠纷的种类进行划分,采用受教育机会权纠纷、受教育条件权纠纷、受教育成功权纠纷的划分方法,以方便对受教育权纠纷司法实践的考证。 第二部分是对受教育权纠纷司法实践的考证。依次对受教育机会权纠纷、受教育条件权纠纷、受教育成功权纠纷的相关案例进行分析,探寻纠纷解决中存在的问题。 第三部分是受教育权纠纷解决中存在的问题。表现为立法缺失、理论困惑、制度缺陷。 第四部分是对现有受教育权纠纷解决途径的反思及理论改造。反思以行政行为为视角解决受教育权纠纷的弊端,采用行政法律关系理论对受教育权纠纷分析,突破行政主体、内部行政行为等因素的羁绊,,以“重要性理论”为司法审查标准,为通过行政诉讼途径解决受教育权纠纷提供新的理论视角。 第五部分是完善我国受教育权纠纷解决途径的思路与措施。一是完善申诉制度的程序性规定;二是明确行政复议在受教育权纠纷中的适用范围,明确与申诉制度的分工;三是增设调解制度作为受教育权纠纷的解决途径;四是构建教育赔偿制度,以期实现受教育权纠纷解决途径的体系化。
[Abstract]:Education, prerequisite for citizens of both development, is also the source of power for national development. In modern society, the right to education is a basic right in many countries, 1 of China's constitution < > forty-sixth stipulates that citizens have the right to education. With the development of society and country, education is increasingly becoming an important factor in the development of the individual, education has also attracted widespread attention of the society, because the citizens' right to education disputes are increasing year by year. But because of the dispute and the legal relief system of the theory is not perfect, the dispute has not been solved. In order to fully protect the rights of citizens to education, this article from the essence of right to education starting with the concept and characteristics of clear right to education disputes, on the basis of the right to education dispute types are divided. Then research on the specific case of disputes of the right to education, analysis of the right to education. In the end, we rethink and remould the existing theories, and put forward measures to improve the ways to solve the disputes of the right to education.
In addition to the introduction, this paper is divided into five parts.
In the first part of the right to education as the essence of entrance, based on a summary of the nature and content of the right to education on the concept and characteristics of clear right to education disputes. Then the types of education disputes are divided by education rights disputes, educational conditions rights disputes, dividing method of success right of education for the convenience of the dispute, the right to education disputes judicial practice research.
The second part is the textual research on the judicial practice of the right to education disputes. In order to explore the problems existing in dispute resolution, we analyze the disputes of the right to education opportunities, the disputes over the right to education and the right to succeed in education.
The third part is the problem in the dispute settlement of the right to education, which is manifested by the lack of legislation, theoretical confusion and system defects.
The fourth part of the existing education and reflection theory to reconstruct the way to solve the disputes. Reflection is the administrative behavior problems to resolve the dispute with the perspective of right to education, the administrative legal relation theory analysis of education disputes, break the administrative body, internal administrative behavior factors such as fetters, to "importance theory" as the standard of judicial review that provides a new theoretical perspective for solving education disputes through administrative litigation.
The fifth part is the solution and measures to improve the measures of right to education disputes. A procedural rules to improve the system; two is a clear scope of administrative reconsideration in the dispute of right to education in the clear division of labor and the appeal system; three is the way to solve disputes as establishing mediation system of the right to education; four is the construction of educational compensation system, in order to realize the right to education dispute settlement system approach.
