我国食品安全领域惩罚性赔偿制度研究

【摘要】：2015年4月7日,新的《食品安全法》千呼万唤始出来。新法出台以后,食品安全领域的惩罚性赔偿制度又一度成为了大家热议之话题。这次惩罚性赔偿标准的改进,对于中国食品安全领域进一步发展无疑又是一次重大突破。但是,在经济迅猛发展的背景之下,我国食品安全领域的众多食品安全问题仍然没有办法得到解决。从生产经营者的角度来看,食品安全领域惩罚性赔偿制度就像是一颗定时炸弹一样,无时无刻不在警示和威慑着生产者和销售者;从消费者的角度来看,完善的惩罚性赔偿机制的设立更能促进他们利用诉讼的手段来保护自己的合法权益。社会是向前发展的,任何法律法规均有可能存在着不足之处,它只能规制已经出现的和我们能够预料到的问题,所以我们应当全方位的去看待和认识它。本文从我国的食品安全领域的惩罚性赔偿制度出发,对现有制度进行分析研究,提出这项制度在实际适用当中存在的一些问题,及其自己的有关看法与建议。第一部分是对选题的背景和意义、国内外专家学者对该领域相关问题的观点以及创作该文章所用的方法进行的陈述。第二部分对我国食品安全惩罚性赔偿制度进行了基本介绍,还对相关的制度概念、本身的特征和功能进行介绍,进一步深入了解这一制度。第三部分主要是对国外和中国台湾地区食品安全领域惩罚性赔偿制度进行了介绍,分别介绍了美国、德国和我国台湾地区有关的食品安全领域的惩罚性赔偿制度,从中借鉴到它们的法律经验,来完善我国对于该项制度的建设。第四部分是现阶段中国食品安全惩罚性赔偿制度的立法现状与实施现状,经过对比,探究我国的食品安全惩罚性制度在现阶段究竟存在哪些问题,从而也凸显出食品安全惩罚性赔偿制度要改革前进的迫切性。第五部分提出了对于中国食品安全惩罚性赔偿制度在今后发展过程中一些完善建议。
[Abstract]:In April 7th 2015, the new Food Safety Law began to emerge. After the new law was enacted, the punitive damages system in the field of food safety became a hot topic for discussion. This time, the standard of punitive damages has been improved. There is no doubt that the further development of food safety in China is another major breakthrough. However, in the context of rapid economic development, Many food safety problems in the field of food safety in China still cannot be solved. From the point of view of the producers and operators, the punitive damages system in the field of food safety is like a ticking time bomb. From the consumer's point of view, the establishment of a perfect punitive damages mechanism can promote them to use the means of litigation to protect their legitimate rights and interests. Any laws and regulations may have shortcomings, it can only regulate the problems that have emerged and we can expect. Therefore, we should look at it in all directions and understand it. Starting from the punitive damages system in the field of food safety in China, this paper analyzes and studies the existing system, and puts forward some problems existing in the practical application of this system. And its own views and suggestions. The first part is the background and significance of the topic, The views of experts and scholars at home and abroad on the relevant issues in this field and the methods used to create this article are stated. The second part gives a basic introduction to the punitive damages system for food safety in China, as well as the related system concepts. The third part mainly introduces the punitive damages system in the field of food safety in foreign countries and Taiwan, and introduces the United States, respectively. The punitive damages system in the field of food safety in Germany and Taiwan has drawn lessons from their legal experience. To improve the construction of this system in our country. Part 4th is the current legislative status and implementation status of the punitive damages system for food safety in China at the present stage. What are the problems in the punitive system of food safety in China at this stage? Therefore, it also highlights the urgency of reforming the food safety punitive damages system. Part 5th puts forward some suggestions for the improvement of the food safety punitive damages system in the future.
