政府规章制定中的公众网络参与研究

【摘要】：当前,随着民主化进程不断加快,公众对管理国家和社会的热情不断高涨,加之网络科技的快速发展,网络媒介异常发达,网络方式方便快捷,公众网络参与也日趋活跃。在政府规章制定中,公众也通过多种网络方式参与其中,并取得了良好的效果。但是由于目前缺乏规章制定中公众网络参与的相关研究,在实践中还存在很多的问题亟待解决,因此,构建统一规范的公众网络参与法律规范,完善相关体制机制建设已经刻不容缓。本研究内容先从研究的概念入手。那么到底什么是政府规章制定中的公众网络参与?笔者通过分析推理,认为它是指公众通过网络以特定方式参与政府规章制定的各个环节并发表意见和建议,以期通过自己的参与行为引起行政机关的回应并对结果产生实质作用的行为。这一概念主要是强调参与的全面性、沟通性以及实质性。公众参与有着广泛的理论基础,这些理论基础给公众参与的发展提供了丰富的素材和养料。笔者认为,当前我国政府规章制定中的公众网络参与有着丰富的实践形式,并取得了一定的发展,但是由于目前公众参与观念落后、体制机制不健全、配套法规不完善以及公众的参与能力不强等都制约着我国规章制定中公众网络参与的发展。与英美日等发达国家的成熟的制度建设相比,还存在着很大的差距。在承认与国外发达国家的现实差距的前提下,笔者提出政府规章制定中的公众网络参与的具体对策,并试图给出其在现实工作中的构建路径。
[Abstract]:At present, with the accelerating process of democratization, the enthusiasm of the public for managing the country and society is constantly rising, coupled with the rapid development of network science and technology, the network media is exceptionally developed, and the network way is convenient and fast. Public network participation is also becoming more and more active. In government regulation making, the public also participates in it through a variety of network methods, and has achieved good results. However, due to the lack of relevant research on public network participation in the regulation making at present, In practice, there are still many problems to be solved. Therefore, it is urgent to build a unified public network to participate in legal norms and improve the construction of relevant systems and mechanisms. The content of this study begins with the concept of research. So what is the public network participation in government regulation? By analyzing and reasoning, the author thinks that it means that the public participate in all aspects of government regulation and express their opinions and suggestions in a specific way through the network. With a view to generating responses from administrative organs and having a substantial effect on the results through their own participation. This concept emphasizes the comprehensiveness, communication and materiality of participation. Public participation has a broad theoretical basis, These theoretical foundations provide abundant materials and nutrients for the development of public participation. However, due to the backward concept of public participation and imperfect institutional mechanisms, The imperfect supporting laws and regulations and the weak participation ability of the public restrict the development of the public network participation in the regulation making of our country. Compared with the mature system construction of the developed countries such as the United States, America and Japan, On the premise of acknowledging the gap with the developed countries, the author puts forward the concrete countermeasures of the public network participation in the government regulation making, and tries to give its construction path in the practical work.
